Great job with starting to prep for NVC guys.... our group is going to fly through that process!!

oh... about the I-864's.... check, and double check, then check a few more times that you are using the correct numbers.... one version wants total income, another is adjusted total..... or something along those lines.... but just be sure you are using the correct info so that you can avoid checklists......this is probably the number one thing I have seen people get wrong.....

Sorry for bothering you too much, But I just want to confirm with you about your answer. So my situation is that I have very little income because I am still in college and only work part time. So I still have to file i-864 right? and you said that my parent with higher income would also file i-864 and other parent would file i-864A. I have a quick question about this. So my dad is the primary person on the 1040 tax return, but my mom is the one has higher income. So which of my parents would file i-864, my dad or my mom? Can someone clarify this too?

Correct, you still file an I-864.

Your mom: I-864

Your dad: I-864A

Order of who is listed on the tax return is irrelevant.

Also, my husband is getting his police records right now. Do you know how long they are valid for? I have heard 3 months and 6 months.

From what I have read in the NVC threads, this is not a big deal.... one option is to get a titre blood test from his doctor. This will show the level of antibodies and if he still has immunity for their list, or it will show what he needs boosters for.

Don't quote me on it, but I am sure it is also okay to say no on the nvc paperwork regarding the vaccine question and then bring in whatever you have gotten since then to the interview....

Thanks for your very helpful info. I am confuse with question 8 part 1 in i-864A form which ask for the relationship to Sponsor. So in my case, I and my Dad, we both fill out the i-864 as a sponsor for my wife, So how do I determine who is it asking. I checked box c which is "I am not the intending immigrant. I am the sponsor's household member. I am related to the sponsor as his/her.

- Spouse

- Son and daughter

- parent

- brother and sister

- Other dependent.

so which one should I check as final option here. the way i file i-864 for me and my dad is the same. So we both considered as sponsor. That why I got confuse here. Hop you can help!

I'll take the second question first.

I stand by my original statement, the fact that you live at the same address at your parents was clear in your earlier posts. You will not get a checklist by following what I said earlier.

Taking the first question second.

I earlier suggested that since your mom was the higher income earner, it is she that should complete the I-864 as a joint sponsor and your dad fill out the I-864A as a household member of the joint sponsor. Since your dad is filling out the I-864A as a member of your mom's household (not yours), he would tick "spouse" for question 8c on his I-864A.

I'll mention this now in case you are not already aware and this is in regard to household count.

On your I-864, you will only count yourself and your wife which will equal 2.

Your mom on her I-864 will count herself, your dad, and your wife, plus any other dependents they may claim on their taxes (her household count will be no less than 3). She will not count you on her form unless you are claimed as a dependent on their taxes.

Hi Ryan,

So if I and my dad file i-864 as sponsors. How they will determine our income requirement. Would they count one time 16k for me as the petitioner and add 5k for each of my household members including my parent? For example, we have 4 people in my family plus my wife. So the total income require will be about 16 + (4*5) = 36k ?

Im so happy right now!! Just checked our case status and it was APPROVED!!! Thank you GOD!! :):) We had one RFE (they didnt have my passport pics) but i took care of that immediately and now, one week later we are approved!! yay!!!

The I-864P shows what the thresholds are. You are approaching this the wrong way, you are not combining income with your parents. Based on what you wrote earlier, your current annual income is insufficient for your household size (2), so you require a joint sponsor. Your mom as the higher income earner will need an annual income to support a household size of 3 (her, your dad, intending immigrant).

You are not combining income with your parents so you dont write anything or you write N/A for that question.

Your household count is 2 because you are an adult who is not claimed as a dependent on your parent's taxes. Just because you live under the same roof doesn't mean you include everyone in the household count on immigration forms. I know how easy it is to overthink things (I did that myself), which is why I attempt to keep things as simple as possible.
