Hey Guys!

I just thought I'd stop by to tell you... case was received today at NVC :D

I called like 40 times and finally got through... was told the case got there TODAY and that in 2 weeks time they should have the case added to the system. Lady also told me I could call in 2 weeks and add our email to receive the info that they send to the lawyer.

As you know, I am visiting my husband so I suddenly have no rush in having to go back and complete the process.. but I am happy it is moving forward nonetheless.

Thank you all so much for your good wishes... seems our case is moving along.

Must be a relief to finally get out of USCIS!

Did you bring all the relevant docs to the US with you so that you can do all the stages right up to medical and interview before having to return to Mexico?

The clearance times at NVC appear to have reduced to just under 30 days after scan date, which is good news for both of us but I have seen threads about website payment chaos over the last few weeks which may slow you down a bit - appears to me that there always seems to be at least one department in the process that doesn't work properly!!!

Does the Mexican embassy have a fairly fast turnaround? It would appear that there's about a six week wait at the UK embassy from the time that NVC instruct them to interview time meaning that I'm hoping for a mid-September interview

How are you? As you know, I am here in the US currently visiting my husband. I called our lawyer to inform her that I was here and wanted to know if it was possible for me to change my ticket from the initial departure (Jun 13) to a couple more months out since I was admitted until Nov.

She got it pretty bad that I was here and advised against extending my trip beyond the return date that I told to the officer at the POE.

This is her reply to my explaining that I have been coming and going to see my husband and for business purposes, and that I would like to stay a couple of months this time:

Hi XXXXXX,

You are risking an inadmissibility determination when you go to your interview at Ciudad Juarez.

Clients who submit B2 visas or B2 renewals while their I-130 is processing are often deemed inadmissible for fraud. (WHAAAT?) Your case presents the added risk that fraud was committedwhen you entered the US and informed the CBP Officer of a departure date that was later switched. (This has not happened yet, I was considering changing the ticket from Jun 13 to end of Aug) If you're deemed inadmissible, your B2 will be revoked, you will have to prepare a waiver, and you would not be allowed into the U.S. while the waiver is processing. Waivers are arduous applications, there is no guarantee that it will be granted, and take over one year to prepare and process. You'd likely have to retain an attorney to assist you with the waiver.

Let me know if you have any questions.

Seems to be a bit of a strange one - as you have already been admitted to the US and are not extending your date beyond your B2. Although it may well have an adverse affect upon future B2's I presume that you are unlikely to be applying for anymore as you hope to have a green card soon!!!

I'm no lawyer but surely fraud exists only if you overstay the terms of your B2 with an intention to Adjust your status or if the entry officer thought you were going to overstay (which he/she obviously didn't as you wouldn't be sitting stateside right now!!) -and which would be a moot point if they pick it up on your flight out!!

As for a possibility of an inadmissibility adjudication at your CJ interview I can't understand how this would apply (it's not an issue that seems to come up for UK residents) but the facts are that you are already in the US, had no issue at POE and will presumably return within the dates of your B2 and, if it were me, I'd be inclined to try not to worry about it as it is a historical fact and worrying about future implications which are out of your hands will have no beneficial effects for you. I'm a 'cross that bridge when I get to it' kind of chap but am more than happy to be corrected by others.

ok so here's the situation now... my husband went to his interview, they couldn't find his ds260 in their database (but we can see it in ceac) so they said they'd reschedule it when they could access it... this was last month. today he went again to take a new PC (other one had expired while we were waiting for his interview to be scheduled) and asked if they had been able to access his form, and they said no they will call him when they can. has anyone ever heard of this or experienced this? He's in Abidjan Cote d'Ivoire ... its very frustrating cuz we are at the very last step and they are dragging their butts :/ is there anything we can do at this point?
