This is torture for you and your family / husband. I'll be the first to break it to you: Your case seem to have fallen into the dreaded administrative black hole that not even congress / senator involvement can expedite. I say this with great certainty and authority. I hate to say this, but it's perhaps better to get to the inevitable already. Your wait is going to be another 7 to 12 months ....12 months. Mexican law authorities aren't very quick and cooperative in relinquishing info to the feds? They're oftentime too disorganized to give timely info needed to finalize your case.

What can you to cushion the wait? Perhaps charity/community volunteer work, helping the needy, learning a new instrument, work on financial goals, engage in activities that your are passionate about that spans a great length of time like ....say...months.

Praying helps. And keeping busy and keeping mentally and physically active / preoccupied helps best. :) :)

10 days away from the 8 month mark, my friends. Still no word or update.

This is creating stress with my husband as we have different approaches to what seems to be an endless waiting.

Just curious... am I the only one in the august group to have been served with the "application on hold due to background and security checks"?

It is my understanding that it is the USC that has to do all that... and well... My husband is a lot less reactive than I am.

If it were in my hands, I would be calling everyday... he just thinks we should wait for this to run its course.

I am so happy that most of you guys are moving along in the process, I know our time will come as well.

The applicant has as much right as the USC to move forward with a congressional inquiry, although the petitioner is the one required to sign the Privacy Waiver Form. One that form the USC petitioner gives the applicant authority to follow up with your district office and /or USCIS.

Nonetheless in a case like UnaMexicana's, a congressman / senator inquiry will only be dismissed, brushed off and /or ignored for as long as possible. Then she will be put in limbo all over again calling that office again and again while that office contacts NSC over and again eventually giving into "will call / email you as soon as we hear something", which unfortunately won't happen anytime soon. Again it all depends on the office and how resourceful and EXPERIENCED the assigned staff is at cutting through the clout.

The background of the USC / LPR factors minimally in Homeland Security and DOS checks in the i130 processing, except if hits on the USC/LPR fall under the Adam Walsh Act or classified military / pentagon hits. However, the applicant's background as well as the background of any of ALL those relatives and even the relatives (who are NOT part of the immigration petition) of your own children (who are part of the petition) factors majorly (if not solely) in the decision / speed with which the I-130 case is adjudicated. A classified military hit or Adam Walsh Act hit will throw an app into a wait sometimes long enough to lapse the time statutes that warrants expiration of a i130 case. They really can't lawfully revoke a petition based on classifies military hits, but DOS sure as hell won't return your file easily (if at all) to USCIS. In such as case, the case becomes more "vigilante" than "humnaitarian".

Sorry to hear you're still stuck.

Somebody mentioned that it may be the Mexican authorities lack of speed but if your hubby is naturalised presumably he's already been through the system (and have received a clean bill of health) and if he was born a USC then the Mexican authorities wouldn't be called upon?

(Assuming that he's of Hispanic origin)...Is there a local Hispanic orientated church near him? I know there's one local to my wife in Florida and they are very pro-active in helping locals with immigration affairs, several of her students have found their help invaluable.

Its good to hear that you are being optimistic and taking everything as it comes and making the best of your situation. I cant even imagine how frustrating it all must be. In the back of my mind, I'm already formulating what we will have to do if my husband doesnt get approved for a CR-1 Visa.

We just finished submitting our DS-260 (online) and I mailed in our I-864EZ last week (which should take 60 days for review). I ended up reviewing my DS-261 on the phone with an NVC rep. Its interesting how the day before when I called NVC they told me to call back in a week to do a phone review. And then when I called the next day about something else, I could review it on the phone. So when you get to that part, be sure to be very proactive and just keep calling and calling. There's another couple from Fiji that I've been chatting with who's I-130 got approved 3 weeks before ours and now I'm a week ahead of them in the process. So calling NVC was definitely a good thing! From what I've been told the Suva embassy (where our paperwork will be sent) doesnt have too many cases, so I'm hopeful that as soon as our case is done at NVC it will be a month or less before my husbands interview and *fingers crossed* his plane ride back here in June or July.

Stay strong, stay smiling, and have faith. Everything happens for a reason. Cuz, hey! without rain, there'd be no rainbows! ;)

Mar 24, 2015 - Called NVC and was able to review DS-261 over the phone; added emails, designated self as agent of choice. Should be able to pay IV Fee & fill out DS-260 in one week (31/03/15)
Mar 25, 2015 - Paid IV Fee
Mar 26, 2015 - IV Fee shown as 'Paid'
Mar 28, 2015 - Submit DS-260

April 1, 2015 - Medical Exam in Suva, called NVC for update on case: said it wasnt in the system yet, still in review. allow 45 days for case complete (hey, thats better than the 60 they said earlier!) They will only email us if they need further information, otherwise expect interview letter in the mail.

April 7, 2015 - Called NVC to follow up, no update given

April 14, 2015 - Checked ceac.state.gov website, saw that there were 3 N/A's, called NVC to verify that case was complete

April 15, 2015 - Received false checklist, called NVC to verify that was actually false checklist (re: police certificate would be sent directly to embassy and therefore was not included with support documents submitted in IV Packet)

April 16, 2015 - Called NVC to re-verify that received false checklist. Confirmed AND was told that interview date was scheduled

May 28, 2015 - Interview Scheduled at 8am, Suva Embassy (need to reschedule due to conflicting obligations)

Sorry, I'm a bit confused!!

Surely the first part of the immigration process, the I-130, for a spouse to come to the US as an LPR (initially CPR) is specifically to check the applicant petitioner's background and the validity of the marriage certificate? If the majority of the checks were on the applicant then why would they not ask for the details which you are later required to give in the DS-260 (Immigrant visa form)? It would make the requirement to obtain a police certificate obsolete if they already knew that the applicant was a miscreant!!

09-20-2018 Transferred to TSC

10-15-2018 Text notification "New Card Being Produced"   YAY!!

My case just got completed this morning at NVC. It took 21 days from my scan date....I still can't believe it . I am keeping everyone in my prayers. Sending good vibes to you all.

10-14-2014 Received NOA1 for I-129F

01-30-2015 Received NOA 2 for I-130 (5 months and 3 days after) :D

01-30-2015 Received NOA 2 for I-129F (3 months and 2 weeks after)

02-11-2015 Received USCIS update (email notification) that case was dispatched to NVC

03-03-2015 Received NVC welcome letter via email with the case no and IIN (31 days from NOA2 date)

03-03-2015 Paid AOS fee

03-18-2015 AOS payment shown as 'paid' (NVC payment portal have had a problem with payments made hence the delay in processing)

03-24-2015 NVC reviewed the DS-261 (spoke to an agent and she reviewed the form over the phone)

03-31-2015 IV payment shown as 'paid'

03-31-2015 Sent in the AOS & IV packages

04-01-2015 Scan date (NVC letter received)

06-30-2015 Collected the passport form the Consulate (passport was due to be collected in a week from interview date but delay in issuing visa due to the system failure in the US Department of State)
