Applying for I-130 in London but need to be in USA to establish domicile/income

Hello everyone,

I must apologize if this question has been asked before but I haven't been able to find it. I am a US citizen, living with my British husband in the UK for the last 2.5 years. We are now applying for his I-130 so we can move to the USA, and I will be filing the application at the London office as I'm resident here. However, I need to be back in the USA with a domicile and an income so that I can then submit the Affadavit of Support (I-864). So my question is, how long after I apply at the London office with the I-130 should I move back to the States? Is there a norm, should I go the day after we send the application, or...?

You can go after applying whenever you like. You could also get a joint sponsor so wouldn't have to have a job in the US for him to get a visa. And you only have to show "intent" to reestablish domicile. You are not required to physically live in the US if you can show your intention is to move back.

Timeline

The only question on domicile I was asked is "When are planning on moving back". I didn't have to provide anything further (I admit, I wasn't even familiar with the rule at the time). But that was it.

It's amazing how many questions can be resolved with a 2 minute Google search...
