Sack the lawyer.

Report her unprofessional and incompetent conduct to the local and state bar associations.

Any competent attorney will tell you that you can sign with your married name.

Idiot.

I can't believe someone with a law degree would even say that USCIS won't allow her a green card in her married name. what a bunch of horse dung!

I would look into breach of contract on their part for a couple of reasons:-

1. They are giving you misinformation. As legal professionals this isn't acceptable.

2. If they've emailed someone not associated with your case, or that you had not previously given permission to be in receipt, then they've breached confidentiality.

Either way, they need to be done with your case. Unprofessional and incompetent is a recipe for legal disaster at your expense, and that's the last stressor you need on top of the entire immigration process.

I would look into breach of contract on their part for a couple of reasons:-

1. They are giving you misinformation. As legal professionals this isn't acceptable.

2. If they've emailed someone not associated with your case, or that you had not previously given permission to be in receipt, then they've breached confidentiality.

Either way, they need to be done with your case. Unprofessional and incompetent is a recipe for legal disaster at your expense, and that's the last stressor you need on top of the entire immigration process.

This is good advice. I'd look into legal misninformation and breach of confidentiality, and include that when you and your husband report them.

Those Lawyers you hire are group of numskulls. As long as your marriage name appears on your marriage certificate, it becomes legal name for immigration purposes. You need to do away with them or else they will complicate things for you in the near future that will make you to keep spending money for no appropriate reason. I did my AOS myself with the help VJ. I went to a lawyer to do it for me and she charge me 2,500.00 just to submit forms to USCIS. It was funny but serious. I went to the library, fill all those forms out and pay 10cent per page to print instead of 2,500.00 to enrich that lawyer for submitting forms. I am going to give the lawyer all the documents they need to include in my package so why can I do it by myself. As long as you can read and write and with the help of VJ, you can do your process by yourself. With the help of VJ I was able to save 2,492.00. I only spent 3.00 for printing.

Even if it doesn't appear (in most cases on marriage certificate are just original pre-marriage names), still can use it.

... obvious reasons? ... what might those be? .... as long as you have stated the facts truthfully, then there are no reasons why you could not make this information public and maybe save somebody else from signing up with this firm. Simple as that ...

Because we are thinking of suing them and we don't want anything to affect the case. Just because they send our case notes to some random person on the internet doesn't mean we have to follow suit. If/when we do sue them you can be sure I will be publishing their name/s for all to see. I just don't want to jeopardize any future law suit we may take against them.

Even if it doesn't appear (in most cases on marriage certificate are just original pre-marriage names), still can use it.

Yep my maiden name is on the marriage certificate as it should be in most cases. As my husband said he wasn't marrying his sister.

Yes!!! It was a typo??

We have already paid our lawyers. I think my husband said it was around $1500 up to now for AOS, but I am not 100 percent sure. We wont be using their services any more.

Hi,

You are not going to get anywhere suing the attorney because you will not be able to show any significant financial injuries from any breach of the contract. Furthermore, you probably waived the right to sue in the contract and agreed to arbitration which is standard in many contracts.

You will also need a lawyer to help you sue another lawyer. This will cost you more than $1500 which you are trying to recover.

The best way to get your fees back is to threaten the attorney with complaints to the local and state legal bars. The potential for a review of incompetence should put some fear in this idiot if she recognizes her mistakes.

Focus on your immigration case.

I just wanted to say a big THANK YOU to everyone who replied to this topic. I can't tell you how wonderful it has felt especially when I felt so defeated and down yesterday! Today is another day, my husband will be responding today, but he most certainly will not be apologising to them, on the contrary! You stay strong! Don't let them get to you! You are a smart woman and you have a lot of courage to talk openly about something that is causing you great anxiety. It's hard to be vocal about a matter causing distress to one's own heart. Props to you miss (or should i say mrs!) :)

You are exactly right, my husband just emailed after consulting another lawyer and they said exactly the same thing. I find this to be unfair, I was ill yesterday through it, my heart was racing and I nearly had to seek medical attention. I also don't understand how a lawyer can be so personally insultive and get away with it. I WILL be reporting them to the bar, I will make it my personal mission to do so, once we have submitted our AOS. Thanks any way.

Thank you. I just really want to do the AOS now and be able to fly home as soon as possible as today I have just been told of some kind of problem there. I don't know if it doesn't rain it seems to pour right now!
