Im trying to fill out 864 for my husband and our household size is 4 with his mom (immigrant). He makes about 34k this year and 30k pervious year. I make about 25k. Together we make poverty guideline but im confused now section household size i put 4 because that adds up ,and then its asking to add if you are going to use ur wifes income so that adds up to 5 people... Are they counting me(wife) twice..do we go by poverty of five ppl in the house i mean do the go by that because then we dont make it.. Anyone...

ok so here it is. I went through the same ordeal. if you make 25k and he makes 34k you do not need a cosponsor. you do need the i864a. in that case part 6 section 13a put total adjusted gross income from taxes there. on the i864a part 1 section 11 put the adjusted gross income there as well. every where else it says to list individual income. in those lines put what you find on your individual w-2s. as far as the household size not adding up, are you adding 1 into the optional box. the household size should be 4.

Don't count anyone twice on the I-864. If you are counted already as wife you do not count yourself again as a household member. You, however, can certainly sign a completed I-864a to show the entire household income and this is prefered if you file taxes jointly.

So my husband he is the petitioner he files the 864 and i (wife) fill out 864a to join our income. Is that correct.... Because at some point i saw 864ez form... And also on his 864 part 1 do i select 1a as the petitioner or 1e am the first or second of two joint sponsors. He is the petitioner for his mom, and im using my income (wife) to add up. And part 5 is household size which im consufes im counted as the spouse because we are married and number 7. It says optional and if you have same principal residence who are combining their income by submit in 864a enter the number...so if i enter 1for myself(wife) the household goes up to 5 ...
