Hi Visajourney members!

My question is about the i-864 affidavit of support form. My husband USC petitioning my son below 21 and his income is not suitable for 3household members. I am green card holder and working already. We filed tax jointly 2013 and my income can help add up for my husband income to support 3household members. My question is do I have to fill up I-864 separately even he is my son? any idea please help. :idea:

yes u have to fill up a separate I-864 and when my husband petitioned my 2 kids he was out of job so we had my sister in law as co- sponsor and we never had a problem.

in your case this was correct, but this is a different case

if you would have had to file an affidavit of support instead of your sister in law, you would have used the i864A and not the i864, since you are your husband's household member

Did your husband already file the petition? Are you at the NVC process already?

Since you are married, you are able to combine your income with your husband in order to meet the requirements. Your husband as the petitioner would file I-864 and you would file I-864A. You would also need your tax transcripts and letters of employment/paystubs to prove your and your husband's current income 125% above the poverty level.
