I had my interview on March 2, 2018. My immigrant Visa application was not processed due to a missing approved F2B retention. As part of the requirement to get an approved F2B retention, a copy of my Notice of Action stating that petition has been approved, was required. However,  I have misplaced my Notice of action. 

 

I have contacted  both USCIS Homeland Security and the National Visa Center (NVC) to obtain a copy of Notice of Action or I-79c (please see below)  Both USCIS and NVC have stated that my case is no longer under their jurisdiction and all my documents are now at the US Consulate in Manila. I have tried to submit the  correspondence from NVC sent to me via email stating that my petition papers have already been processed on their side (hence petition has been approved). However, it was not accepted by the receiving department at the US Consulate, Philippines. My petitioner's naturalization certificate, CENOMAR and my signed letter request to opt-out are all available.

 

 

 

 

Did you meet Consular Officer to explain your situation and showed the emails? In case they do not accept yout F2B status, you should ask them if your case could be back to F1? Because it is current now.

 

You have to find a contact or book a meeting with Consular officer to meet someone to solve this problem.

Sorry. I forgot that you are in Philippines, and F1 is behind F2B. In case you cannot find a Notice of Approval and they do not accept the fact that this letter was lost, then you have to wait several months until F1 is current.

 

They need that letter to check if your parents became a citizen before or after approval. In fact, they can check the system to know your case's approval and your parents' citizen date. But they ask the hard copy while it was lost, so it is impossible for you. Let's hope you can persuade them or pray that F1 will move faster so you can have a Visa.
