Hi Everyone,

I am a US Citizen and my wife and I got married 2 months ago. My wife entered the US with her mom as visitors in 2000 and have been overstays since 2003. We are now in the process of completing all forms for AoS and it is my understanding that my wife's overstay is likely to be forgiven. However, on G-325A Biographic Information, we have to report my mother-in-law's current city and country of residence. I am worried because UCSIS may question my wife's mother's current status in the US because of my wife's current status. Through the G-325A review, will my mother-in-law be scrutinized? What are the consequences and how should we go about it?

That does not sound likely but not that relevant.

Your MIL is not part of the process. You need to complete the form factually and honestly.

Do you mean their visitor visa expired in 2003? They've probably been overstays much longer, if they arrived as tourists in 2000. They were probably given 90-180 days on their I-94 and every day after that had been overstay.

Not that it matters right now, but if/when this comes up again, you should be aware.

Thank you for your comments. They were very helpful. I have a follow up question:

My wife currently only has a "copy" of the approved I549 "Application to extend/change nonimmigrant status" which extended her stay as R2 from 2000 to 2003. This copy is the only version where her I-94 infrormation is available. At the bottom right of the I549, it notes "Please tear off form I-94 printed below, and staple to original I-94 if available".

Basically, the back of this is just plain white blank because only the front was photocopied a while ago. Will this be okay?

We do have her original passport she entered the US with with the immigration officer's admission stamp.
