my mom in law is filing out the i864 form already my husband doesnt have work yet but he plans to get once we file the dcf. so she's supporting my husband me and my daughter.

question is we will file for my daughter now but we wont bring her with us yet when we get approved cause she stilll has school here in PI.

will my mom in law need to include her in the i864 form? fyi my husband is not the biological father

If your daughter was included in the petition, yes, she need to be included on the affidavit of support. Once approved you and your daughter have approximately six months to use the visa. Your daughter can continue her studies in the US.

07-24-2014: Sent I-129F package

07-25-2014: I-129F delivered

07-29-2014: Notice Date for NOA1

07-31-2014: ARN changed

08-05-2014: NOA1 hardcopy received

Since the daughter will be on a separate petition, I don't think she needs to be on the aos. Unless your mil is going to be supporting her on an aos in the future. Its one of those things that is in the instructions, and how its phrased. If its asking for those she is currently supporting vs if it says those you are and will be. But if you plan on having your own job to be able to do he daughters aos yourself, well then that makes it so the mil is off the hook.

Each i-130 leads to an individual case and application. Each applicant needs their own aos.

I hope I said that halfway coherently. Get my point
