If that is true then wouldn't everyone plan to enter as "a tourist" and then get married here after few months & apply for adjustment of status?

That's fraudulent use of a tourist visa, although it happens. It's easy enough to lie and say you'll be going home and then just never do it, but that's directly against what that AOS option was designed for. Some people are denied entry to the US on tourist visas because they have so many possessions with them that it looks like they're moving. If you were to turn up on a tourist visa and tell customs you had no intention of going home, they'd put you on a return flight straight away. Lying about your intent is a misrep that can get you deported and banned from the US.

It's also worth noting that the legal AOS option is available to comparatively few people, because you need to be part of the VWP or have a valid tourist visa to get to the US in the first place. Applying for a tourist visa during IV processing is difficult in part because it opens up this loophole and the government doesn't want it abused.

That's fraudulent use of a tourist visa, although it happens. It's easy enough to lie and say you'll be going home and then just never do it, but that's directly against what that AOS option was designed for. Personally, I find it aggravating for an immigration officer to ask someone who has just gone through a year or more of waiting for USCIS and NVC why they didn't consider the fraudulent use of a tourist visa instead. Am I asking immigration officers if they have considered taking monetary bribes and claiming tax credits they aren't entitled to so they can retire a few years early? No, I don't do that because it's completely rude and inappropriate! This is what I meant when I said I would probably lose my ! :)

I'm the USC petitioner. My wife is British (now a USC!!!), generally awesome, and amazingly patient.

Hi,

I am new here.

I received my case complete email on July 29th and have been waiting for my interview at the Montreal consulate. When I call the NVC they told me that my case was actually completed on July 22nd but that I don't have an interview scheduled yet. I noticed on the Interview Date spreadsheet that others from Canada have their interviews scheduled even though their cases where completed after mine. It must be due to the type of immigrant visa I have applied for.

My wife has her EB-3 based green card since March 2014 and lives in the US. So I have been at the NVC since March. I applied for a following-to- join benefit so my visa type is EB-3 because I am a derivative beneficiary. I did not have to submit an Affidavit of Support as part of my paperwork.

Do you know if EB-3's are a lower priority for interviews than IR-1? Also are the questions drastically different at the interview? I am thinking I should bring an Affidavit of Support just in case the interviewer requested it.

When we got married many years ago, my wife was on a tourist visa and it was a post-POE decision. So yeah, it could happen legitimately.

You're not alone, I'm EB-1 and I've been waiting since July 30th. It must be the visa category then.

To be on the safe side, bring everything your wife submitted for her petition and interview.

Would be interested to know the CC and scheduling dates for your wife.

When we got married many years ago, my wife was on a tourist visa and it was a post-POE decision. So yeah, it could happen legitimately.

Yeah, absolutely. My response was because OP put "a tourist" in quotations like that... I read that as insinuating there would be some premeditated plan to adjust rather than legitimately entering as a tourist. Plenty of people adjust status in the US for completely legal, valid reasons -- like people on student visas who fall in love and marry USCs, or in your case when the decision to stay together was made after entering the country.

But yeah, I thought that was a crummy question to ask during interview. What a punch in the gut.

green card based applies for immigrant visa is slower than USC applies for immigrant visa cause green card bases has to look up the priority date where USC doesn't have to I believe. USC cases is when they get CC, the NVC will directly forward to the embassy for interview scheduling, but green card based has to check the priority date to see if it's current. I think that's how it goes.

I called earlier today and was told they will not schedule anything this week :(. Hope she was wrong. They have always scheduled before the month end for the past 5 months or so, I believe. It does not make sense.

My wife's interview was today and she was approved! :dancing: The interview took 20 minutes and they asked 14 questions. Why? I don't know. But the worst is now over. Thanks everyone for all the help. We couldn't have done it without VJ. :)

CEAC still says Ready. Is that normal or should it be showing Administrative Processing?

Mine never showed AP, it was Ready ... then changed to Issued day after the interview (around 11am).
