Hi all,

I am not really new to this thread, I have been reading it forever. I just haven't had much to post until now (waiting for my CC). I have a written confirmation from NVC that they received my IV and AOS packages on July 22, although sometimes they try to tell me that it was July 23. Anyway, I have a question for those who were able to travel back to the US on a B1/B2 visa while waiting for their CC. How likely is it to get a B1/B2 visa while waiting for a CC? Is there any point in trying?

My timeline for NVC processing:

May 4, 2014 Submitted DS261

May 7, 2014 Paid AOS fee

May 12, 2014 Received an email confirming that my DS261 (agent registration) form has been processed

May 15, 2014 Paid IV fee

Last scan date: July 22, 2014 NVC received my IV and AOS packages (mailed together), date confirmed in the email on Aug 5, which also told me that it will take at least 60 days to process

July 25, 2014: Submitted DS260

August 6, 2014 Requested an expedite

August 8, 2014 Got an email from NVCExpedite asking for two phone numbers

August 8, 2014 Responded with two phone numbers

August 15, 2014 Received an email from NVCExpedite which states: "The US Embassy or Consulate is willing to expedite this case once we have all the fees, forms, and documents. We received documents for your case. Please allow 60 days for us to review your documents."

August 15, 2014 Called NVC, the rep told my husband that while the Embassy has agreed to expedite my case, NVC will still take at least 60 days. The reason that NVC cannot do it any faster is because they cannot sort through all the mail to locate my case.

September 16, 2014 Got a checklist for a divorce decree, the original of which I submitted. They said it needs to have a stamp, even though it was issued by a US judge, whose office confirmed that their original decrees do not have stamps. [/background][/size][/font][/color]

September 29, 2014 Mailed a copy of the decree with a certification and stamp attached to it. The judge's office in Lancaster county, Nebraska, said that this is how they certify their documents. They still do not put stamps on originals or copies themselves.

October 2, 2014 Checklist scan date

October 17, 2014 AOS fee changed from "paid" to N/A

October 20, 2014 Case complete confirmed by calling NVC.

I have a question. I have a lawyer with my case. And because of him, my DS 261 is by-passed. So my AOS and IV both will be accepted and passed in said time which is 2-4 weeks ? Is lawyer with case gives us advantage ?

Please help.

Does anyone have lawyer with his/her case ?

If you already have a B1/B2 visa, then it is likely you can enter US with it, though risky.

Applying for a B1/B2 visa at this stage is, I believe, a no go. One of the questions you need to answer on the application form is whether you have applied for an IV. Answering yes will doom your non-IV application, and answering no will doom your IV case as well.

If you have a pressing need to be in the US ASAP, then the better option is to request an expedite from the embassy through NVC.

You already got the only advantage your lawyer could get you (DS-261 bypassed, a huge advantage by the way), apart from legal advice to you. From now on, you fall in step with everyone else. Plan on 6-8 weeks of NVC foot dragging, maybe more.

In fact, your lawyer could cost you more time if he/she is not extra careful in filling the forms and submitting the documents. Study thoroughly Post #1 of this thread and insist on scrutinizing every bit of correspondence with NVC before your lawyer sends it out and request a duplicate to yourself as well.

I repeat... Study thoroughly Post #1 of this thread before anything gets sent to NVC.

I have a question. I'm pretty sure I submitted the wrong kind of form as my birth certificate for my IV package. Since I'm sending the checklisted AOS documents to the NVC anyway, could I add the correct form for the IV package along with those with the IV cover sheet? Or do I have to wait for another checklist? :crying:

If u r sure then U shouldn't wait for the checklist. Send with AOS checklist. In case u don't get checklisted for the birth certificate still it wouldn't affect ur case since u wouldn't be getting a case complete without ur AOS checklist reviewed anyways. So there is no harm in sending it right now.

NVC will forward your original documents to the embassy prior to your interview. Bring the copies just in case, but rest assured the consulate should already have your originals when you arrive for your interview.

You can bring photo copies to consulate at interview and you can tell them that the originals are already given to NVC.

It is ok with that.

I came back just to check on you and other friends!

How are things going with you? Looking at your timeline, you've made some progress! Good luck with the rest of your journey!!!

It feels good seeing a post from you. I wish you and family a very happy home.

I also miss Sukie, Changnoi, Lifeonhold and Lucybelle, I guess they all are doing great. I wish the rest of us a smooth sail thru this immigration process.

Thank you for the response! This is kind of what I was thinking. I actually did apply for an expedite and got a response that, while the embassy has agreed to expedite my case, I still have to wait for the 60 day processing with NVC.

Then it is no expedite at all!!! If you were told this over the phone, then it's probably a figment of the phone rep's imagination. NVC should have sent everything they have as is to the embassy ASAP. If the decision was made over a week ago, chances are your case is already on its way to the embassy, or is there already. Check the CEAC status.

If not, I would insist on speaking with a supervisor over this. I would also contact the embassy and complain that NVC is disregarding their expedite decision.

VJ members could be of more help to you if you detail your timeline in the signature, including date and manner of this vague expedite approval.

Just made my last phone call ever to NVC. A month after CC, we finally got our interview date.

Your well wishes and prayers made it happen, I'm sure. Thank you all, especially you two soloenta and msc13. I'm almost in tears thinking of you both.

Congratulations. You are almost done with this LONG journey and very soon all this nightmare will soon be OVER.

Ok I finished catching up on the last 30 pages since my last visit, this thread moves so fast! Today is 30 business days since my AOS package, I called yesterday and talked to Sarah. She wasn't very helpful at all, every question I asked she just kept repeating wait 60 days. I asked "60 calendar days or 60 business days?" All she would say is 6o DAYS, I could not get her to commit to one or the other.

The only helpful thing I got was when I mentioned that I sent in my civil documents before my ds-260 she said, "oh, that's good!" So that was a bit of encouragement.

At the end of the call I got a syrupy sweet, "thanks for calling,and have a wonderful day!" It was almost dripping with sarcasm, but not quite.

I was really hoping to be done by November, but it's not looking too promising right now. Monday is a holiday so nothing is getting done until Tuesday no matter what AustinCanada says (if emoticons worked on my iPad I'd put the laughing guy here!!!)

Oh well, at least I have this forum to make me laugh about it all.

The Reps are more like a ROBOT or PROGRAMMED MACHINE when they keep repeating 60days 60days 60days 60days.
