Hello All

My Wifes father expired 3 months back and we are still stuck at NVC stage. My wife is going through a very tough time right now.

Can I file NVC expedite based on the above situation with the necessary docs

Please advice

I'm sorry to hear about your father in law, I can understand how difficult it on both of you. You can file the expedite, but my only advice is, please don't get your hopes up. It seems to be notoriously difficult to get one, but it won't delay anything by requesting one, so go for it. And good luck!

I would like to know your advice, I am a Jan. filler and I have no news up to now. what do you guys think should I call USCIS to follow up or wait more?

I'm unsure what step of the process you are at so can't assist without clarification: Have you had your NOA2 from the USCIS and waiting for your case to arrive at the NVC? :time:

Hello Friends.

I am seeing an immigration attorney for the first time tomorrow as I seem to be hung up with the I-864. I need to file jointly with my dad as Joint Sponsor since I do not yet have a job in the US. Can anyone provide information on the following items?

  • I am having a hard time getting my tax transcripts - will a copy of my last three years' 1040s & the French equivalent of my last three years' W2s be acceptable (I have worked in Frnace the past three years)? Saylin says that the transcripts are recommended but I can't obtain them.
  • My dad, the Joint Sponsor, will be providing tax transcripts for the past three years
  • On the I-864 it asks for my CURRENT INCOME. I do not have a job in the US but was employed in France until August 13th. Should I use the annual income earned for 2014 from January - mid-August to describe my CURRENT INCOME?
  • My AOS fee has been invoiced and I have paid it. WHEN WILL THE IV APPLICATION PROCESSING FEES be billed? It is still listed as Payment Status: Not Invoiced

Any opinions on this would be very welcome :)

I submitted AOS with 2013 full return (self employed, including all schedules and 1099) because my transcript was not ready.

I have my transcript now. I am on the fence as to whether to send it in. My fear is this:

-if AOS gets approved without this being needed, it will "reset" my 60-day clock and AoS will be "un" approved. :(

The flipside is, if they ask for it in a checklist (note, I do not have a checklist yet), sending it early may prevent that.

I don't know. Any thoughts? Thanks in advance :)

I have the EXACT same dilemma, I got my transcript on Friday after requesting it on June 14. Have you decided yet what to do? I'm leaning towards sending it in, but scared

Thats not true. There have been people who have been successful at getting members of congress to help push their case along. It depends on the congress person. I have been in contact with this office previously regarding public policy issues. I voted for the senator so i will do all i can to get help with my case. Dont get a attitude with what im doing with my own case. Il do whatever to get my husband here.

Go back in time and hire a lawyer. Then the DS-261 will be skipped and the IV bill will be invoiced around the same time as the AOS bill.

Other than that, there's no shortcuts and you have to wait your turn.

Hi Saylin, on that note, does it matter who pays the fees and submits documents to NVC? I am the beneficiary and I told my lawyer that I will pay fees from my US account and send docs myself. He said if Attorney is on file and applicant starts submitting things, it causes delays. I don't see how me being an applicant doing things on my case would delay anything, would it?

I don't see how that would delay things either. They're probably just saying that to scare you and to have 100% control.

I don't see how that would delay things either. They're probably just saying that to scare you and to have 100% control.

My thoughts exactly. I was just wondering because I paid both fees over the weekend and it still shows In Process, might take few business days to get taken out of bank account and show as paid.

-If you're abroad you cannot obtain your tax transcripts online. You would have to get them mailed to you. You can try using the 1040s, etc but need to put very legibly that w2's do not exist in France and what the equivalent is.

-if you have no job -or- you are working abroad and the income will NOT carry over to the states, your income will be $0...

-IV bill will be invoiced once they review your ds261.. That can be up to 60 calendar days or more with current processing times...

I'm the USC petitioner. My wife is British (now a USC!!!), generally awesome, and amazingly patient.

I've obtained tax transcripts online while abroad.

Sometimes it's due to the address having to be put in a certain way, and others who are abroad had issues obtaining them due to the foreign address.
