I only sent in my 2013 tax returns since my 2011 income was also low; I didn't have a job for the full year so only made close to $20k. They sent me a checklist only for not filling out the AOS completely but they accepted all of my other documents and never asked for me to submit the other tax returns, so I believe you will be alright by only sending in the 2013 tax returns.

I am sorry if this has already been asked, the search function is not the best. Question: is it still true that if you have a lawyer (from the USCIS stage) you get to skip the choice of agent step (DS-261) and the AOS/IV fees get invoiced at the same time? You literally don't have to do it, it gets skipped? Will it show up in the portal? I read about this on the NVC guide but I wasn't sure if that information was up to date. Can someone who has a lawyer confirm? Just trying to avoid delays in this stage. Thank you!

Hi everyone, Saylin and NLR,

I do not know if this question has been asked or not but I need your advice badly, my husband was a student with part time jobs in 2011 as stated in Tax transcripts, my question is: do I have to explain and mention in cover letter why my husband had $3800.00 income during that year? or leave it as it is just include the Tax transcripts 2011 without any explanation?

You don't have to explain, but you can just include one or two sentences on the cover letter that he was in school in 2011 with a part-time job. We did on our AOS cover letter, but I doubt it made any difference.

I have been reading around and still haven't seen the answer to my question. Please if anybody has the answer, share and shed the light on the issue. My current income is well above the P.G. Last year tax return, which is the only transcript I'm planning to send off, is well above the P.G as well. However, the 2011 is way bellow that guideline. That year I was still going to school and I made only 13,000.00. Do I have to send the transcript for all 3 years or only the 2013's?

I see so many people ask similar question but no one really answered that.

Can some one please take the talking stick? I'm all ears. :)

As it states right in the question, you either send in the most recent year (2013) or all three years (2011, 2012, 2013). Regardless of what you sent in, you still have to fill out all three years' information on that question ;)

Although I didn't have a lawyer, yes the information in the NVC wiki is correct. As it's mine, I keep it completely up-to-date ;) The DS-261 form is to choose an agent. As the lawyer will be automatically selected as agent, the form then doesn't apply to you. So, the IV bill will be invoiced at or around the same time as the AOS bill.

Well, I'm glad to see that you got to pay the AOS and IV fees at the same time because you have a lawyer. :thumbs:

So you're now waiting for a CC. :yes: Me too! :whistle: I really hope we both get a CC next month! :) Fingers crossed! :star:

USCIS was horrible to me at every stage, later transfer than everybody else, approval delayed by several months (2-3 months later than same PDs, plus 1 month lost for RFE), very delayed transfer to NVC after approval (almost 4 months). NVC has been super nice after USCIS, having a lawyer helped here, though it had got me an RFE at USCIS. In the long wait for approval I found this site and took charge of NVC. With other's experiences and Saylin's extremely helpful wiki, I overcame at least two blunders the lawyer was making; one was he wanted to wait until the barcode sheet came in mail, perhaps he didn't know we could print one out as soon as we pay the fees :shrugs:. I have seen in many cases that lawyers had messed it and people were firing them.

Anyway, now we wait for a CC, fingers crossed for a speedy CC without any dreaded checklists.

I filed for my wife I-130 in late Feb of 2013, was approved end of Nov 2013 by USCIS, NVC didn't scan my case till end of Dec 2013- Jan 14

So my case has been at NVC since at least Jan 2014, about 8 months at NVC at this point.

I admit I could have been faster at getting documents sent to them. They had all the documents they needed by mid-May, however was checklisted in early June for AOS because i answered a couple questions wrong. Thankfully no other problems with any of the other forms, however then I learned about the delay. I expected case complete by August.

Resent the needed AOS forms again, the receive date was July 1st....so I am waiting for a response now.

Actually, you are ahead of me, lol. I am sorry both the stages have been delayed for you. After 16 months at USCIS, I can't imagine another 8 months at USCIS. I hope this ends soon for you and you have a smooth interview.

If your lawyer sent in a G 28 form to USCIS then the DS-261 will be skipped and both fees will be invoiced at the same time. I had a lawyer and this worked for me. You can see other examples on Saylin's spreadsheet where both fees were paid on same day, all of them had a lawyer. However, I remember seeing one case where the lawyer had not sent that form and that couple had to do the DS-261.

Ok guys...I've been waiting for the 60 days wait to be over...one more week left...but I just checked the status online...and the "AOS fee" showed up as N/A, before it used to be "paid" and the IV still is in "paid" status....but is it a good sign? I hope it is...I asked this question to the rep when I called last week and the guy said...it doesn't mean anything good or bad...and he can't answer to that question...

From reading people's previous posts, it means you have case complete. You should call tomorrow and confirm!

December 30th 2014 - Case Compl........NOT. So after not having an interview date yet, I called again on Jan 30th and apparently its in final review with a supervisor.

February 6th 2015 - Case Complete: Supervisor called from NVC to confirm everything has been completed now.

March 27 2015 - Interview Date

March 27 2015 - Approved!

Although I didn't have a lawyer, yes the information in the NVC wiki is correct. As it's mine, I keep it completely up-to-date ;) The DS-261 form is to choose an agent. As the lawyer will be automatically selected as agent, the form then doesn't apply to you. So, the IV bill will be invoiced at or around the same time as the AOS bill.

If your lawyer sent in a G 28 form to USCIS then the DS-261 will be skipped and both fees will be invoiced at the same time. I had a lawyer and this worked for me. You can see other examples on Saylin's spreadsheet where both fees were paid on same day, all of them had a lawyer. However, I remember seeing one case where the lawyer had not sent that form and that couple had to do the DS-261.

Yeah, we did submit a G-28. Amazing, it looks like we can save some time at NVC. That is really good news. Thank you so much!
