It doesn't matter how many people live under the same roof as her. The important part is how many are in the same household (ie, who does she financially take care of and/or who takes financial care of her, based on tax returns).

she is not working , she is a student and she is not required to fill taxes

It depends on how many people your wife has claimed in her tax return. For example, she just claimed her lil boy as the depend on tax return. So in I846, total household will be 3. Those are herself, her son and you

If he filed form 1040a, i don't think 1099 applies. they want the 1099-misc as non-employee compensation or rental income etc., not interest income etc. unless he has unemployment compensation or IRA distribution but i do not think it applies to him. So i would think if he only works for the company, W-2 is enough. but if he had form 1099-misc, he can't file form 1040A, it has to be 1040... Tax does sound confusing especially the forms..

anyone corrects me if i'm wrong.

Thank you for the reply. He said he submitted 1040a and he is not sure if there was an attached 1099 on 1040a. He relies a lot on his accountant thats why he is not that familiar with this forms. If 1099 is not applicable to us do you think we will still be gettting a checklist?

He's not self-employed is he?, or has filed a 1099 due to an interests/dividends.. etc? Not everyone who files taxes has a 1099 :). It's only if your tax return had a 1099 with it, must you provide it with the return you send to NVC.
