Guys someone who has their I-864 approved please clarify my doubt,

My wife a USC living in California, has never worked, does not make any income and has never filed taxes. We submitted our I - 864, 2 weeks back along with a joint sponsor who makes well above the income guidelines....

Since my wife never worked and filed taxes, we submitted a signed letter stating she is unemployed and does not have any income. Along with the letter we also submitted an IRS VERIFICATION OF NON FILING LETTER (4506-T) for the last 3 years 2011, 2012 and 2013. I hope this will suffice the NVC no tax filed requirement....

Since my wife technically does not have any IRS tax return form 1040, 1040EZ nor any income reported to IRS for any of the years, in the I-864 form, under Part 6, Sponsor's Income and employment we have marked 'N/A' for the tax years 13a,b and c and 'N/A' for the total income 13a1,b1 and c1. Like I said we have submitted a signed letter stating she is unemployed and does not have any income. And the IRS VERIFICATION OF NON FILING LETTER (4506-T) for the last 3 years 2011, 2012 and 2013 clearly states "We do not have any record of any filed form 1040, 1040A or 1040EZ for your social security number"

Do you think it will be an issue since we have filled the Part 6, tax years and total income with 'N/A' instead of '0'? Will my wife's explanation letter along with the IRS verification of non filing not suffice? Some one please give me your views...

Someone please correct me if I am wrong, but I believe it is encouraged to put "0" if you have no income instead of N/A. I think (but don't remember 100%) someone received a checklist for putting N/A instead of 0 where it asks for tax years and the total income. Your best bet would probably be to call up the NVC. :)

30 business days since my DS261 and still no IV fees :crying:

Now I'm freaking out reading about the whole w2 and 1099 thing...

On June 14 I faxed a 4506-T to request my tax transcripts for 2010, 2011, 2012, 2013 (can't request one online if your address is foreign). On July 10, I got 2 envelopes in the mail, one that said I never filed for 2010, (I DID!!! but used my married name by mistake, my SSN is in my maiden name) and my transcript for 2012. I figured the 2011 and 2013 got buried in the bottom of the postman's mailbag and waited patiently until July 19 before sending my AOS package with a copy of my 2013 return instead.

I had amended all 3 returns in June because I didn't know about the form to exclude my interest income from my Canadian RRSPs (it's like a US IRA - but not.) I also didn't know about the FBAR requirement for foreign bank accounts so I filled those out too under the streamlined tax compliance program.

So with my AOS package I sent my 1040, and the 1040x along with the required 8891's. I never sent w2's or 1099s because I never got any, my income is in Canada. On July 28th I started getting antsy because I still hadn't received my tax transcript for 2013, so I requested it again. Still nothing, and I'm hoping and praying I don't get a checklist for those w2's because I don't have any, and because I still haven't received a transcript I can send. AAAAANNNNND I still don't have my IV fees invoiced.

Looks like my immi-versary in November will come and go and I'll still be stuck in Canada, I was reallllly hoping to miss the worst of the winter storms this year :(

I am bringing my stepdaughter here and am still waiting for the IV fee (I check everyday!!). I was wondering if there is ANYTHING to do to make it go faster?? She has .. issues? Her ex boy friend is a member of the MS-13 street gang and has been threatening her life and the life of her mother and little brother. They don't report things to the police because most of them are corrupt. I feel like we are so close to bringing her here but SO FREAKING FAR. My husband is freaking out because there is nothing we can do...

Just got off the phone with Joy at NVC... 41 minutes on hold. I cringed when I heard her name from what others have posted, but she was actually pretty nice. Maybe she got talked to about being rude, or maybe there are 2 Joys that work there, not sure.

Anywhoo, I asked her again when my DS261 and AOS packages were received, the dates she gave me were different from what I had recorded. She said July 9 for the DS261 (it was July 7 before) and EP packages received July 28, July 31, and Aug 8. August 8 makes sense because I sent my IV package August 7. July 28 and 31 for the AOS stuff doesn't make sense, because I sent it July 21 and then the 23 when I got the message that my files had password protection. That is a pretty long delay. Oh well at least I know what they are going by. Now to update my spreadsheet form for Saylin :thumbs:

I asked Joy when I could expect the invoice for my IV fees... she said it should be by next week but she would put in a request for a supervisor to make sure.

Call the NVC, ask to speak to a supervisor and ask for an expedite because you feel her life is in danger.

As for the AOS gap, the DS-261 is an online form and likely "received" sooner than an email which is a different process than online forms, hence a possible reason as to the gap. And maybe there was a higher amount than normal emailing in packages too :P

They are asking for your total income. If you total income is 0 then that is what you need to put. N/A stands for Not Applicable since she is a US citizen it is applicable.

Sometimes things are outta ur control. I already mentioned I m the beneficiary and my husband wasn't believing the fact that tax returns can't be sent alone. I got to the point where I got tired of arguing and said that fine send whatever u want. That's the reason I have been so anxious all these 45 days because I know what's coming. I realized the second he sent as well that he screwed it up but I couldn't do anything about it. U have everything in ur hands ur case in different.

I've seen people not getting a checklist in spite of mistakes in their AOS packages. :wacko:

I hope they still accept your AOS package. Fingers crossed! :star:
