I put the document cover sheet.. the operator told me to do this. Instead of att crm aos I put crm IV.. idk if that matters but it's what I did.. fingers crossed

Some of my husband's docs will expire and I can't risk that

Did a quick read about K3 (didn't know about it):

1. K3 takes as much time to approve as I-130.

2. Consulates stop processing K3 once I-130 is approved, anticipating imminent IR-1/CR-1 issuance.

3. Thanks to NVC, "imminent" stretches to several months now.

What was the purpose of K3 again? Baaah... what do I know!

What I'm interested to know is if the K-3 was ever really more efficient. It was implented in August 2001, but with 9/11 happening just after this implementation and the changes from INS to DHS and USCIS, I wonder if this visa has ever been used the way it was meant to be used.

I was reading an archived article from August 2001, and at that time, the I-130 took about a year to approve, but instead of going to NVC, the petition went directly to the consular post for interview. So, at that time, the NVC factor wasn't even in play. I learned something new today!

Can anyone tell me how long their fee payment portal displayed the "case in process of termination" message before they were able to pay the fees?

 

 

I'm the beneficiary, wife of USC.
12/30/2012: Got engaged.
1/16/2013: Got married in India.

I-130:
2/28/2013: Attorney mailed the I-130 from a U.S. address.
3/4/2013: Priority date, NOA1.
11/6/2013: Case was transferred to Nebraska Service Center.

1/6/2014: 60 days of transfer are up, put in an e-request, given 30 days' time. Contacted the senator. Senator asked to wait till Feb 6 and if nothing then she will do something.
2/5/2014: Website status changed to RFE.
2/10/2014: Attorney gets RFE. They need G325A and photos of both me and husband, original marriage certificate, copy of marriage record and it's translation.
2/15/2014: Mailed the requisite documents to husband.
2/19/2014: Documents received by husband.
2/24/2014: RFE mailed.
2/26/2014: Case status changed to RFE review.
3/6/2014: After 367 days, NOA2.

After approval kept calling NVC but NVC always had one reply, file was not in their system. Husband too called USCIS National Customer Service Center and was told case was sent to NVC.
4/2/2014: Write to NSCFollowup to know about the status of the petition.
4/10/2014: Put in a ?service request with USCIS starting with OVP to locate case.
4/16/2014: Reply from NSCFollowup that the U.S. law prohibited that office from responding to anyone other than the petitioner and to have the petitioner contact them.
4/18/2014: Sent email to NVC Research to locate the case.
4/22/2014: Petitioner sent email to NSCFollowup
5/14/2014: Receive email from NVC Research that they do not have a record of receiving the petition.
5/16/2014: Congressman's immigration caseworker contacted supervisor at NSC who said the petition is pending and will be dispatched in two weeks.
5/27/2014: Petitioner received response from NSCFollowup that the case was pending an internal extended review. Really?
6/19/2014: USCIS case status change, "On June 19, 2014, we shipped this case..."
7/1/2014: Case received at NVC.
7/14/2014: NVC case number assigned.
8/1/2014: AOS and IV fees invoiced.
8/2/2014: AOS and IV fees paid.
8/5/2014: AOS and IV fees status changed to paid.
8/6/2014: AOS and IV packages mailed, completed and submitted DS-260.
8/7/2014: AOS and IV packages delivered to NVC.

I received a letter today from NVC that it is going to be 60 days from June 8th before we get notice on our case.It states they have a lot of cases to work on. I am just sick to death of his government.

A friend of mine received the same exact letter. Did your letter blame the delay on USCIS, too?

What's wrong with I-130 NOA2 ==> Consulate (bypassing NVC) ==> K3 Visa ???

Let NVC play God as long as they want as long as it's a matter of an eventual adjustment of status while US citizens are living happily with their loved ones. Why reserve this privilege to illegal immigrants? That's what US representatives should be lobbied for instead of asking them to intervene for individual cases at the mighty NVC.

I'm so curious if this will work well. Doing that could shave 40ish days off the process if people could start sending in their IV packet without waiting the 30 business days for the invoice to become payable. Doesn't matter much for us since we are still waiting for police cert and an original birth cert which will be a few more weeks anyways, but that would be a really helpful strategy for people just entering the NVC.

The purpose of k3 was the exact what we were just discussing about. To unite families in this log process. It was a temporary visa which was given to the immigrant spouse so they can apply and live in states. The difference between k3 and k1 was that first it was for spouse and second that person can work and do everything that a green card holder can do right away. The condition for k3 is that as soon as 130 is approved, k3 is closed right away. Now what stupid Uscis does is that they approve both together at same time so k3 kind of has become obsolete. Otherwise this was the perfect happy thing for us all going thru this process.

I received a letter today from NVC that it is going to be 60 days from June 8th before we get notice on our case.It states they have a lot of cases to work on. I am just sick to death of his government.

Just to keep some hope alive, I received an email from the NVC this week saying they had received documentation and please allow up to 30 days for review. We can't really trust anything they say, and I do think that things will start (and already have been) taking longer than 30 business days. However, the fact that some official correspondence and many operators still say 30 business days is a small glimmer of hope. Once all official responses change to 60 days, we are in trouble...

Can someone please tell me if all the checklist cover sheets are the same? I received a false checklist when my AOS was accepted. I'm waiting on an IV checklist email that contains the cover sheet. I'm not sure how long the email is going to take to get here. I was told I got the checklist over the phone 2 days ago. Can I use the false checklist cover sheet with the IV Docs I have to send in?

An AOS checklist will be different than an IV checklist. If you don't want to wait for the checklist, then use the respective bar-coded cover sheet from the payment portal for the package.

:no: K3s have to Adjust Status, like K1s. So, even though they get to the US faster than IR-1/CR-1 applicants, they aren't allowed to work right away (not until their AOS paperwork is approved [AOS in this case standing for Adjustment of Status]).

Ohh MoBar, how I tried :/ My Senators and Representative want nothing to do with streamlining the legal immigration process, but they're all about granting all sorts of concessions to undocumented immigrants. One of my Senators is running for re-election and a volunteer knocked on my door asking for support. She couldn't have been a day over 18 so I gave her the benefit of the doubt and told her I'm voting for the other guy before I slammed the door in her face. The next volunteer gets to see my immigration binder!

Truer words were never spoken! If my husband were with me, I wouldn't even care how long NVC took. This process would go from a complete life ruiner, to merely annoying and expensive.

They didn't say USCIS but stated they received a large caseload. I don't know what is going on. This is just too much to handle

In the letter my friend received, the second paragraph said they are currently receiving an increased number of approved petitions from U. S. Citizenship and Immigration Services (USCIS). As a result, we are experiencing increased review times for documents received.

What I want to know is, how many resources were exhausted to type and send these letters out!! Could have been spent reviewing documents, me thinks.
