Reposting my question again - any help?

My i130 was approved on July 8 and NVC received my file on July 17. I received my Case # on Aug 6 and paid the AOS fee and now trying to gather documents for AOS package.



After been on Visa Journey for a while, I realized that I don't need my attorney anymore as keeping him is nothing but delaying our case further.



VJ members are more knowledgeable than him.



I have a question regarding i864 form, actually I have more questions but I don't want to through all of them at once.



My wife did not work last year after our marriage and I support her financially. Since she has no income I have completed one from I-864 for her and I have a co-sponsor as my father-in-law but he file taxes jointly with his wife. Do I have to fill out I-864 for my father-in-law and I-864A for my mother-in-law? BTW she doesn't work.

Congratulations, you are the third person to tell that calls to NVC are getting answered quickly. Maybe they hired additional staff.

Sparrow20 was calling really early in the morning, so it's possible that they just weren't backed up yet. But hopefully they also have additional staff answering phones ... but especially ... REVIEWING DOCUMENTS!! Yep, that would be super cool.

Timeline

For the AOS you only need joint sponsor and household member proof of citizenship or LPR status. Petitioner's isn't required.

For IR5 - visa for a parent of a USC - the petitioner's original (or certified copy) birth certificate and all marriage certificates are required for the IV package.

Thank you, they made a mistake then they asked for me to send it for all when I called. But then they make mistakes all the time.

Hi there,

Yes I think if ur docs were delivered on 8th then they would scan in 2 days. Call Nvc on Tuesday.

I have already commented on july thread that Nvc might take more than 30 business days . According to the scanned days we can calculate the processing time/ days.

My guess is till they hit 15th of July Nvc is going to have difficult time. After that they will speed up.

hi, the documents were delivered on August 7, Thursday; I couldn't wait until Monday so I called Friday night and the operator said they received my documents on Friday.

I-130:
2/28/2013: Attorney mailed the I-130 from a U.S. address.
3/4/2013: Priority date, NOA1.
11/6/2013: Case was transferred to Nebraska Service Center.

1/6/2014: 60 days of transfer are up, put in an e-request, given 30 days' time. Contacted the senator. Senator asked to wait till Feb 6 and if nothing then she will do something.
2/5/2014: Website status changed to RFE.
2/10/2014: Attorney gets RFE. They need G325A and photos of both me and husband, original marriage certificate, copy of marriage record and it's translation.
2/15/2014: Mailed the requisite documents to husband.
2/19/2014: Documents received by husband.
2/24/2014: RFE mailed.
2/26/2014: Case status changed to RFE review.
3/6/2014: After 367 days, NOA2.

After approval kept calling NVC but NVC always had one reply, file was not in their system. Husband too called USCIS National Customer Service Center and was told case was sent to NVC.
4/2/2014: Write to NSCFollowup to know about the status of the petition.
4/10/2014: Put in a ?service request with USCIS starting with OVP to locate case.
4/16/2014: Reply from NSCFollowup that the U.S. law prohibited that office from responding to anyone other than the petitioner and to have the petitioner contact them.
4/18/2014: Sent email to NVC Research to locate the case.
4/22/2014: Petitioner sent email to NSCFollowup
5/14/2014: Receive email from NVC Research that they do not have a record of receiving the petition.
5/16/2014: Congressman's immigration caseworker contacted supervisor at NSC who said the petition is pending and will be dispatched in two weeks.
5/27/2014: Petitioner received response from NSCFollowup that the case was pending an internal extended review. Really?
6/19/2014: USCIS case status change, "On June 19, 2014, we shipped this case..."

Having sent the AOS and prepping for the IV -- hopefully a month from now?? -- we're trying to get ahead of the game. I've reestablished domicile in the US and my partner is still in Vancouver, Canada. Since it's my understanding that a police certificate has to be sent as part of the IV package, she was planning to get one in the next few days so we have it when needed. However, according to the police department, we need paperwork from the party requesting the document! See below. Does anyone have experience / advice around getting around this so that we can get the certificate now instead of waiting until it's really needed?

To process your request, we'll require the following documents from you:

  1. Original document of:
    • one government piece of ID with photo, name, address (e.g .drivers licence, BC Identification Card), OR
    • two pieces of authorized ID, both with your name and one including address (e.g. health care card, utility bill).

    and

  2. Paperwork from the second party who is requiring the Police Clearance Certificate (e.g. Consulate, agency, foreign employer).

Hey all,

I need to vent :( my husband in NY called NVC and he got through right away and the wait wasn't as long as before. Anyway, we got bad news!!!!!!!!! The rep said everything has been reviewed all is good, but there is an error on the AOS and we will be emailed a checklist with details this weekend. I can not express to you all how frustrated, angry and upset I am right now. We hired a lawyer and he reviewed everything. He even took his sweet time reviewing everything and said everything is all good. But that is not the case! What's the point spending money on a lawyer if he aint gonna do the job right!!!!! I cant stop crying :'(

Does anyone know how long more it will take for NVC to review checklist docs??? I cant bare another '60 days'.....

If I understand the procedure the petitioner is on the I864 and cosponsor uses the I864A. I am not using a cosponsor myself but from what I have read(obsessively) that is the way I understand it. Just thought I would try to help since I seen you hadn't got any responses. Hope someone that knows more could chime in.

Hi there,

I am from Vancouver. Well actually Richmond. Anyways, i went to the police station asked for police certificate. They asked why i needed it. I told them it was for immigration. They asked me for paperwork and i told them that paper/letter was not given, but is needed for US immigration. They took down my drivers license, asked to write my name and phone number on a piece of paper and told me to sit and wait. 15 min later police certificate was ready. I signed and they signed. I paid $58 and went home. So mo worries :) she will be fine. Hope this helps!

Thanks for your response Seanimo. I was using Saylin's instructions on NVC process where she mentioned that for co-sponsor we can use either i-864 or i864A. So I thought I should better use I864 now my only question is since my co-sponsor filed his taxes jointly, do I have to include his spouse on i864A?

I think you misunderstood the wiki. Joint sponsors use the I-864. Really, only spouses of joint sponsors should be using the I-864A. And it doesn't matter if the joint sponsor filed taxes jointly or not, the spouse doesn't have to file an I-864A; it's up to them.

In either case, both the petitioner and joint sponsor would file their own I-864. If the joint sponsor's spouse decides to contribute, then they'll fill in an I-864A.

I want to share about my checklist. It was for my marriage certificate in native language(Urdu). Although it was mentioned under country reciprocal documents that English marriage certificate is also good but they didn't accept it. So all from Pakistan must include this. Same is for police certificate because there is a set pattern for them which they follow and send you a checklist if it is different in any manner.

Hi. At the USCIS stage we got an RFE for the marriage certificate in native language (Urdu) along with translation; we are from India. At the NVC stage I didn't want the checklist for same and sent it in the IV package. So I guess it applies to not only Pakistanis but every country that if you have a marriage record in your native language, you need to send it both to USCIS and NVC.
