Hello all,

I have a question as I am now thoroughly confused....

We had recently received our NOA2 and were awaiting the letter from NVC with our case number, etc...

Rather, we received yesterday a letter from the US Consulate in Belgium.

This is creating confusion because:

I am a US citizen residing in Belgium currently however we requested the package be sent to the Moroccan consulate in Casablanca on the I-129 form (Part 2, 36a 36b) as we understood it that we needed to make the interview in my fiance's place of nationality. As such, we had planned to relocate there for the final phase of the K-1 process and explained this in the I-129 packet.

We have received no letter from the NVC. We have no case number or any other info indicating why our case was sent to Belguim rather than Morocco. The US Consulate in Belgium will not take questions or appointments regarding the visa process.

What's going on???

Why send the packet to Belgium? He is not a resident, should we go ahead and file the visa paperwork here? Does it matter? I am so worried that if we continue at the wrong consulate this will reduce our chances for getting the visa. Should we request a change in Consulate or just continue?

I will contact the NVC and the US Consulate in Morocco today to see if I can get any answers, but I thought I would check here for any advice.

It's nothing to do with place of nationality, they arrange your interview at the place the beneficiary legally resides. There's no need for you to relocate to Morocco (unless you had already planned that) just for the interview.

What's the current address of your beneficiary that you put on I-129F?

There are several members here their I-129F approval sent to different consulates. Also, when you received letter from NVC it should contain all information including your case number.

Make a call to NVC, asked them to change the consulate. Persistent. Most of VJ members here were successfully changed the consulate. Good luck!

If the beneficiary does not legally reside there, why would you put their permanent legal address as there?

You should have put the beneficiary's address as their place of legal residence. You will have to call the NVC to explain this and fix the address of the beneficiary.

His mailing address was listed as Belgium but his address abroad (p.4) was listed as Marrakech. We also included a letter of explanation in the packet regarding our location status, ie. that we currently reside in Belgium but will relocate to Morocco. We requested notices go to Belgium but the file go to Morocco.

I contacted the NVC. They don't deal with the case after it has been sent. They only follow instructions of the USCIS. They have nothing to do with the selection of the consulate nor can they change or re-forward the petition to another consulate. I am currently on the line with USCIS to try to get more info.

I didn't receive a letter from NVC. I had to call to get my case number and other info.

No, USCIS is not dealing anymore with the approved petition after sent to NVC. It is not USCIS assigned a case number but NVC. It is not USCIS fault but NVC. They are the one who decided which consulate beneficiaries will go for interview. Call them again.

Funny, I just got off the phone with NVC. They gave me my case number, verified that they sent my package to the US consulate in Belgium and confirmed that any other concerns regarding the embassy will have to be taken up with the embassy or USCIS. They have nothing to do with the selection of the embassy. On the contrary, they (NVC) firmly said it was not their problem.

I am thoroughly confused again ;)

Of course they don't want to take responsibility for their fault. I knew some members here that their approved petitions sent to different consulate than written on I-129F. NVC is a part of the US Department of State which is responsible arranged interview for beneficiaries (some countries), assigned case number, and sent to listed consulate. USCIS only decided whether approved or denied a petition.

Another call to NVC. Different response:

The petition was sent to the wrong consulate, it indeed should have been sent to the requested consulate.

Since the petition has been sent out already to the Belgian consulate, it is up to me to contact the Consulate in which I want to transfer to (Morocco) and make a request to do so.

Anyone experience with transfers and transfer times in this region?

The call center for the non-immigrant visa service at US consulate Casablanca cannot help. A call to US consulate Rabat: please call back tomorrow.

This stuff is exhausting!
