Dear Sir/Ma'am,

Please help me to review my ROC packet. I have a little complicated situation here. If there are any kinds of advises were given, I appreciate very much. I am the husband and the beneficiary. Here are all the information I provide.

= Cover letter to explain my situation

= Application check $505.00 and bio-metrics fee $85 total of $590
= Joint Application form I-751
= Copy of USICS form 1-551 (permanent resident card, front and back)
= Letter from Bank of America verifying of our joint savings account since 2012-2014.(with average balance and total balance)
= Copy of joint savings account statements (monthly) from BOA from 2012-2014.

= Copy of our three months both of our checking account statements (separated) as a supplementary info.
= Copy of our Citibank Credit card and statements. (But her name was add only to my account on April 2014, would it be too short?)

= Copy of my wife bank account transaction detail which she pay for the internet service of our address and internet service bills. The internet service account is on my nick name. (I highlight the transaction time and payment amounts then they can compare with the bills. However, I only have one year transactions, because I cannot track back the transaction more than one years ago .)

= Copy of my wife over one year transactions to my I-Pass. (Because she doesn't drive, will it be a good evidence? The problem is, The I-Pass website only shown the transaction amount and time. No prove that the money was from my wife account. Anyone help?)

= 3 affidavits' letters from landlord and 2 neighbors.
= Copy of my driver license and her State ID (she doesn't have a driver license, as she doesn't like driving.)showing same home address.
= Copy of wife's last 3 months Hinckey Spring (water service) bills, two or three of her medical bills and medicine labels in 2012-2014 and one bank letters in 2014 with same address of mine.

= Copy of my electric bills last 3 months, 2 or three letter from school at 2013, and one vacation packet sent from Disney in 2012. (Prove our address is the same for these 2 years.)
= Copy of lease since 2012-2014 with the same home address and both of our names on the same lease.
= Copy of our Disney vacation doc. (2012), Six Flag ticket(2013) and Orlando trip (2014). All the doc. have both of our names on it, associate with photos (Around 10-15 photos each events)

= Our daily life photographs (Around 28 photos)(Usually are the photos take we took together, some dinner that we cook for each other or the photo take we took when we ate outside.)

= Our Student ID in the same college

= Our transcripts in this two years that prove we are studying in the same college.

1. You may start to curious that why I have to provide the school stuff to USCIS. In fact, My wife and I are college students. I am a full-time one and she is a part time and a full-time housewife. Both of us are 22 years old. Our living are sponsored by oversea family. (Non of them are US citizen or live in US and they don't know we got married.(As my family did not like my wife and my wife family did not like me before we come to US, now is better, be still not a good time to tell them.) They just know we lived together. That's why we did not file tax. and i do not expect they are going to write me a letter for our marriage or my ROC.

2. My wife is not a driver, that's why I did not put her name on my car and car insurance in these 2 years. However, in July 2014, because she try to learn driving, although she is not a driver yet, we started to finance our first new car (with both of our names). Is it a good information to provide?

3. We ain't got life insurance because we did not expect die as we are just 20 years old 2 year ago. And health insurance is too expensive for students.

4. Our financial situation is very simple, my wife have only one checking and saving account in BOA with no credit card and I have 2 checking and one saving and 2-3 credit card for daily usage. As we are students, we do not have common asset. I believe it is one of the most obvious problem in this case.

5. About the cover letter, what should I tell them?

What do you think? Is it a good ROC packet? Anything I can do more about?

Thanks! Happy Chic. The affidavit that i talked about is required by the USCIS (at least 2 US citizen). They have to write a letter that is about they are acknowledged my wife and I is marriage. My point is, there are not many common wealth that we share, all we have is one joint checking account. Would it be too limit to prove our joint finance?

I think you prepare a great ROC package!

1. No problem being students, also your living are sponsored by oversea family is not a problem either. However, if you did not file taxes, I'd suggest you write an explanation. Maybe because you two do not make enough and are not required to file taxes with the IRS? If you do not tell USCIS, then how would they know about your situation(s) or your reason(s).

2. Yes, both your names on the car is a great information to include.

3. No problem. We did not have either life insurance of health insurance.

4. No problem. We did not have any common asset, no mortgage, and I did not include the lease either. I'd suggest that you print every page of every statement you can get from BoA checking and saving accounts. Same for credit cards. You might have read that you only need to send in one statement every 3-4 months. But hey, if USCIS wants to see joint financial records, why not giving it to them?

5. I did not write any cover letter. I did, however, write a simple letter about our life together as a happy married couple. That also took care of the affidavit(s).

10/2001: arrived as a F1 student (college) in NC
01/2003: met my now-husband at school
08/2004: moved to Louisiana to continue study

AOS: I-130 and I-485
06/2010: got married in NC

01/2011: interview and approved

ROC: I-751
01/14/2013: Package Sent

06/12/2013: got approved!!!

06/14/2013: card and letter arrived!!!

Exactly 5 months!!! No Interview. No RFE.

Strongest Evidence? My 8-year relationship and 3-year marriage to my husband.

If it does not show commitment, then I don't know what does...

06/27/2014: Received NOA1 (Letter dated 06/20)

07/07/2014: Walk-in Bio (Appt date 07/18)

10/09/2014: Interview Date

10/21/2014: Oath Ceremony

Affidavits are not required.

In fact, no one piece of evidence is required, strictly speaking.

Really? because according to Instruction of I-751, it says,

"affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted, and it must also contain the following information regarding the person making the affidavit: his or her full name or address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge."

Am I made mistake? Thanks for your advise anyway, Harpa.

Harpa is correct, affidavits are not required. In the 751 instructions are examples of evidence, not requirements. I never submitted any in my packet.

Day 0 - 2 May 2012 Mailed AOS package overnight delivery
Day 139 - 17 September 2012 Interview & APPROVED on the Spot!! :)
Day 145 - 23 September 2012 Received Green Card!

ROC - Eligible June 19 2014

Day 0 - 18 June 2014 Mailed ROC package via 2 day priority

Day 42 - 29 July 2014 Approval and Card Production Email

Day 49 - 5 August 2014 Received Green Card

If you have friends in the USA who know you as a couple - people you socialize with, especially people who have been to your house - I don't think affidavits would hurt at all and might well help.

I would try to make them as specific as possible. For example, to the extent it is true, having someone mention the number of times they have seen you together, been to your house, etc. If you two belong to some kind of social club or activity together that would be even better. Mentioning how you conducted yourself while together. For example, I am a bridge player and I have lots of women I have played bridge with regularly but I didn't typically kiss them or hold their hand at the bridge club - we were just partners and friends.
