Hi there,

Does my wife's status as a prior green card holder or as the mother of a U.S. citizen and minor change anything about how we should proceed, or should we expect to follow the same procedure as the first time (i-130 + documents, then i-485 + documents + interview)?

My wife and I previously secured a green card for her and lived in the U.S. for just under two years. During that time we had a child who is a U.S. citizen. We then moved to Canada and voluntarily surrendered her green card. Now we're re-starting the process to move back. I've finished our i-130 and I'm starting on everything else and I wanted to check before really going down the rabbit hole.

I guess that's right - I don't see a previous i-485 in our paperwork so it looks like we didn't do one? I'm trying to research why we won't need it but I've got to start working soon, so I'll dig into it later. Bit of a relief to hear we just need the i-130 plus documents.

You don;t do the I-485 at all. After the I-130 is approved she applied for the visa. Once she enters the country with the new spousal visa, as you have been married over 2 years, she will get a ten year greencard. No I-485 will be filed, ever.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
