We received a RFE a few days ago stating that basicly stated that I do not make enough money!. This is very frustrating to me because the tax transcript sent clearly states that I was at about 5,000 above requirements for last year, that is down because of a job change and 12 weeks off for trip to the Philippines and wedding etc. I am looking for advice or ideas here. They are asking for past 6 months paystubs and I can't find them. I think they were disposed of so essentialy lost. Why would they say I don't meet income requirements?

Background, I drive a truck over the road so I share an address with my sister who is on disability. Wondering if they are saying that makes 3 at this address? She is not part of my ousehold responsibility tho correct?

Looking for some advice here please. Should I try and call and point out that I obviously do meet the income requirements?? Schedule in Infopass appointment or what??

How would they know who is in your household?

You said last year you were $5000. But what is your current that's what counts. So you say 12 weeks off and you are down. That would be why. Your current has to be at or above the guidelines.

I am wondering why they sent RFE at USCIS stage when the Affidavit of support isn't needed until interview how odd.

Income was 24K, 5k above requirements for 2 people. Down from normal 40K ish. I sent Tax transcripts for last 3 years.

If you did not send paystubs, what proof of your income did you send? letter from employer, etc?

05-18-2022: Filed N-400 online. Received online NOA and Biometrics re-use.

06-03-2022: Interview scheduled (online notice).

06-10-2022: Interview letter received via USPS.

My sister handles my mail and it can be problematic sometimes. Maybe, I can get the payroll company to reprint them for me. I will have to ask.

I am also curious as to why a RFE on income so soon, even before the biometrics appointment.

We really appreciate all the help given here. Thanks so much to everyone. Still hoping to hear your thoughts because this is driving me crazy. We have to go back out on the road again tomorrow so I will be making some calls to my employers payroll for letters of employment and hopefully reprint the paystubs. Will be 2 or 3 weeks before we get back to handle this unless I get lucky and get thru the house sooner.

Oh dear. When Adjusting status, you must provide proof of CURRENT income. sending tax transcripts shows what you made previously and paid tax based on that salary, but that's not evidence you are still making 125% of the poverty level based on your household size.

You need to get proof of income and send it asap.

ya, the I-864 is very specific -

must show:

1. prior years income - that's easy - tax data from tax returns/transcripts

and

2. current annual income. Usually this is a projection, what you will accrue in 2014. ain't no tax data on this for most folk. Usually can be shown via paystubs, deposit statements, letter from employer, etc.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Ding Ding Ding thats the thing. I totally missed your Status. I saw K1 and thought why is he getting an RFE so soon! Sorry :oops:

But you are Adjusting of course all has to be sent and all.

You didn't show current. Think this way. Why would your past matter they want to know if currently can you support your wife and she won't be a public charge.

So get yoru most current paystub, employment letter together before your RFE deadline.

The letter of employment just needs to state like below (I pasted and copied mine for ya just in case)

Date: July 9, 2012

Re: D Wheels – Employment Verification

To Whom It May Concern:

This letter will confirm that D Wheels is an employee of SIS and has worked for SIS since July 9, 2012 as a QA Analyst. She is paid an hourly rate of $ XX.XX per hour, earning a yearly salary of $XX,XXX. She works a full-time 40 hour work week schedule.
