no "subtype" on i-485 for fiancee visa

My wife entered on Fiancee visa (thanks to visajourney) and we've submitted the adjustment of status i-485. But on the "check your case status page", to see processing times, you select the type

so I select i-485 , but it asks me then to select a sub type

Based on asylum

Based on refugee

Based on employment

Under Hatian

Under Indochinese

Under Nicaraguan

None of those sub types seem to apply, so I can't get the processing times, so I can't know if it's time for me to call and ask about my wife's application.

we received the notice of action 797C on 5/16/14 and did the biometrics a few weeks later. I'm trying to find out the processing times to estimate when it will be all over. The Receipt number is MSC...

So how exactly do I tell what the processing times are for the adjustment of status?

Up to a year.

I know you're an expert around here, and I thank you for the answer. But most processing times for similar things seem to indicate about 5 months.

I understand it "could take up to 1 year" but where is the data showing the current times between 797c and "interview"? I couldn't seem to locate that specific information. And also, regarding the specific egov form, what items would I select to view the processing times according to them?

If you get pick for a interview 5-7 months if your get picked for interview waiver up to a year. We filed 12/18/2013 got BIO's in March still waiting for Green Card. We were selected for interview waiver. You want the interview.

Ah, I didn't imagine the wait would be longer without the interview. Are there any stats on probability of interview/waiver? When/how did you find out you were "selected for a waiver"?

Our Bio's and Combo card came pretty quickly then the waiting game. Are u planning on traveling to someplace her passport wont take her? If not the combo card let's her work and get back into the US.

Well, we actually submitted our i485 after the fiancee visa expired so I didn't want to risk leaving the US even WITH an AP card. I read that it was not a guarantee to get back in, so you better have a valid current visa besides the AOS application. We want to visit her family in Mexico when we can.

So you got the interview waiver letter about the same time as the Biometrics, just a couple months after filing?

I read that it was not a guarantee to get back in, so you better have a valid current visa besides the AOS application. We want to visit her family in Mexico when we can.

So you got the interview waiver letter about the same time as the Biometrics, just a couple months after filing?

Relax. First the Fiancée visa expired the day she used it to enter the US. Her lawful status after arrival was dictated by the I-94. Did you file AOS before the I-94 expired? If so, she has no overstay. If not, the overstay will not affect her ability to use the AP. If you really feel that way because she is not guaranteed to be readmitted to the US, then she should never travel until becoming a USC as they are the only ones GUARANTEED to be admitted back into the US. All others it is up to the discretion of the CBP to deny entry and have the person hauled in front of an IJ to revoke your LPR status--this rarely happens to people unless they are living in another country and just returning to the US in order to keep the GC. She will use either the AP or the GC to re-enter the US. As long as she is not out of the US for more than 6 months at a time or for more than 6 months in a one year period, she will have no problems leaving and re-entering the US. So fell free to use the AP as that is why you applied for it.

Which USCIS local office is processing your wife's application ?

Timeline

The local office processing times will not be relevant if the OP's case stays at the NBC for processing without interview, but could still check there to see how long it might be if they get an interview.

The NBC does not list processing times for family based AOS. You would need to check the timelines and progress of others in the AOS Progress Reports sub-forums. You could even become part of the thread dedicated to those that filed in the same month as you.
