Hi all,

My situation is I had a history more than 10 years ago in my country. And when I applied the k-1 visa, I had already submitted the history documents to the US immigration office. Two years ago, when I applied the green card, I did not submitted the documents because I did not bring the document to here. But I did attached a letter to explain this and they approved me and give me the green card.

my question is- Now, i need to fill out the i-751 and they request to provide the criminal documents again!!! It is impossible for me to get this(i have to go back to my country and find a agent to translate it). Should i just write a letter to tell them i had already submitted this when i applied the K1 visa, or I really have to go back to my country to get this document.

Please advise friends!!! I really worry about that.

You want the EAD? You need the paperwork...translated, of course. If it's too much of a hassle to get the paperwork together, don't apply for the EAD.

And whenever you send copies of paperwork to any US agency, save copies. Forever, or at least until you're a citizen and you don't have to worry about it any more.

They don't have to issue you an EAD if you won't follow their rules.

I'd just write the letter again. It worked with the 2 year green card, why would it not work with the removing conditions? They have the previous documents you filed. Everything you send to them, they do keep. Getting a copy back is not easy, but they can get to it if they have the need. You really should save copies of everything they send you in the future, but I think you're already kicking yourself for not doing that :lol:

And whenever you send copies of paperwork to any US agency, save copies. Forever, or at least until you're a citizen and you don't have to worry about it any more.

That sounds a little harsh. The OP is concerned and he isn't applying for an EAD. He is filing for ROC.

To the OP: I understand your concern and I would be too, because if the documents were already submitted once I would find it unnecessary to have to submit them again, especially if you haven't lived there since. If you were able to get your AOS approved with a letter specifying that you had already submitted that as part of your K1 process, then it may be possible for you to do it again. However, it can't be guaranteed that they will accept that again. You should see if there is a way for you to get the documents without having to go back to your country. Some jurisdictions allow for these things to be requested by mail or even online nowadays. Or if there is someone in your country who can get it for you and have it shipped to you. Also keep in mind that you will need these documents if you apply for naturalization so I would just try to find a way to get them now and don't send the originals. Good luck!
