My PD is July 09 2014 and I called today to ask for my interview, I was told I'm under CSPA review. I've submitted all forms and documents. Please does anyone have an idea of how long it'll take to review my case to get interview.

Being under CSPA review means you aged out of 21 yrs as a result of delay from USCIS before your petition got approved. So, you'll have to wait until you are current and then file for an immigrant visa. You have one year from the date you became current to seek an immigrant visa.

I called NVC and asked about ma case Then the representative said we are on the way to review your i864 So i was devasted is not done yet... He said i send to supervisor Then i said NOOoo because it ll take an other 42 days he said no it could be before that then i explain my situation he said we still working with pd 15 june it s not a deadline your pd is not current yet the way i see you can have a cc even before vb out... So i don t know what to think

I called NVC and asked about ma case Then the representative said we are on the way to review your i864 So i was devasted is not done yet... He said i send to supervisor Then i said NOOoo because it ll take an other 42 days he said no it could be before that then i explain my situation he said we still working with pd 15 june it s not a deadline your pd is not current yet the way i see you can have a cc even before vb out... Lera! I'll say you give it a try. I'm hopeful you'll get CC in days if you call constantly.

In my case was placed on Supervisor Review on 20th October and on 2nd November after speaking with my husband on phone, I told him to call NVC immediately he dropped the call that he'll surely get to speak with a supervisor.

He called me back saying he already spoke with two reps and that no supervisor was available.

He called me like 3mins after saying he called again and was lucky to speak with a nice rep who finally connected him to a supervisor after severally trial.

Sorry, my post keeps cutting.

Do not mind some reps, they seem to know nothing. Yeah, you not current but will be current when January VB is released next week. Just, don't get tired calling. my hubby usually call in the evening. Plead with any rep you speak with that you seriously need to speak to a supervisor.

Hi all,

Seems it's for F2A category applicants. So, I had my I130 approved back in April 2015. My priority date is June 2014, and as you may know I have been able to file my adjustment of status application since Oct 1st with the new tables for family-based petitions. I did so yesterday, cause I felt more comfortable if my PS was current. However, one point still bothers me: when we received the approval notice, it had one comment saying that I would not be eligible to apply for AOS. Has that happened to any of you? If it helps, I am an international graduate student and my wife who petitioned for me is a legal permanent resident/Green Card holder. I have always been legal on an F-1 student visa ever since I got here for my graduate studies. Do you think that was only because the priority date was not current at the time of approval notice? Thanks y'all.

The Child Status Protection Act (CSPA) and the Within One-Year Requirement

U.S. immigration law normally limits dependent or derivative status to children who are under 21 years of age. For U.S. permanent resident (Green Card) application, the Child Status Protection Act (CSPA) allows derivative benefits beyond the child's 21st birthday, if certain conditions are met.

Previously, a child who turned 21 years of age was no longer eligible to receive a Green Card as part of a parent's immigration case. This is true even if the child had aged out because of U.S. government's immigration processing delays. The Child Status Protection Act was intended to help alleviate this "child aged out", and the Child Status Protection Act contains a formula for determining the child's CSPA age.

An important restriction to eligibility under the CSPA is the requirement that an applicant seeks to apply for U.S. permanent resident status within one year of an immigration visa becoming available. Therefore, to preserve the child's eligibility for immigration or U.S. Green Card, the child must apply for the U.S. immigration within one year of the time when the immigration visa for the child is considered to have become available.

The action that must be taken within the one year time period generally includes filing one of the following: an adjustment of status application (Form I-485), a following-to-join application (Form I-824), or an immigrant visa and alien registration application (DS-260).

The appropriate actions depend upon the location of the child. Any of these actions constitutes applying for U.S. permanent resident status, and it will suffice to freeze the CSPA child's age. Failure to take one of these actions within one year may result in loss of eligibility under CSPA for the child.
