I have a few questions.

You mention that you want her here in America. You did not say how long.

Your options are the Cr-1 VISA, K-1 Visa and Tourist Visa.

You also mention that she is your girlfriend.

The only option you have based on that status is for her to get a tourist visa to visit you in the States. The K-1 Visa Petition does not apply to your situation without being engaged.

For the meeting each other. Can you two just meet somewhere else? Like Thailand? Beautiful Country!

Op said he cannot leave the country, his probation officer will not allow it.

Unless she applied for a tourist visa at least a couple of times and got denied, no chance of having the meeting requirement waived.

So you are on probation for another 5 years? Will you be able to travel at all during that time, say to Mexico for a weekend, or will you not be allowed to leave the country at all?

Yes in the future maybe a year or 2 later but right now I cant.

Getting a hardship waiver is almost impossible to achieve. It will certainly not be approved because you are on probation. The waivers relate more to medical or religious grounds. I have only heard of a handful of people being approved, so plan on meeting again.

You will have to look into either getting her to come and visit you or if she is not able to apply for a visitors visa then meeting in a mutually acceptable 3rd country.

There is no way around this and if you apply without meeting you will only be wasting your own time and money as they will send you an RFE (Request for Evidence) and deny the petition.

Skype logs and phone calls are all secondary evidence.

Hope you can find a way.

I spoke to my lawyer and he actually said that the waiver does apply to me because not only is it a hardship but my probation shows that it is impossible for me to leave.

Again, the fact that you are not permitted to travel to her is understood here; it's the fact that your gf has not even attempted to obtain a B-2 to visit you that would trip you up right now.

For a waiver request to be granted (and the odds are slim, but you already get that) you would need to show that you cannot visit her and she cannot visit you. She won't be able to do that without applying for a B-2 at least once.

How about visa stamps? Maybe friends had a photo of you. It will be very impossible to have no single picture. Just saying.

I contacted the US district prosecution office because I believe that they have my old passport which has all the visa stamps. They said that they will get in touch with me so Im just waiting on them and yes I do have few pictures but unfortunately none with her because I never thought that one day I will marry her.

How does one get engaged anyways? Haha. Just saying.

Trust me if I they were to let me go to Thailand I wouldve not had this problem in the first place. They wouldve let me go to Armenia too.

I personally told her to not apply for a tourist visa, because if she's denied which she will be for sure my lawyer said that, that might not help in the k1 visa. I heard from several people that if your denied of visa you have to wait another 6 months in order to reapply. So that is why we are not taking the risk.

Good, Luck, you are going to need it, regretfully, but this would be a truely miracle, by not having the "together time".,.,.positive proof., I am a short timer here, but I have not seen an approval, without, evidence of the "required meeting".,.,..,and the other requirement, "you are free to marry".,.,.,that is the two requirements for a K-1.

The attorney is probably a good idea.

The attorney is probably a good idea.

The offense was bank fraud and my lawyer said that I could have been charged with murder and that would not matter. The important is that she doesnt have a conviction. And yes we are both free to marry.

This is not correct at all! A denied tourist visa does NOT effect a K1.
