Hello everyone --
I have a very complex situation and would appreciate your insight

• 1977 -Immigrant petition was filed by my Mother and left for US.
• 1988 - Went back to home country to live with Grandparents. Greencard expired and lost immigrant status
• 1995 - Went back to US on Tourist Visa (Stayed for 6 years and overstayed visa)
• 1999 - Married US Citizen in US
• 2001 - Went back to home country with US Citizen son and Immigrant petition was filed by ex-husband US.Citizen. Visa was denied due to overstay and was subject to 10-year ban. Waiver for Hardship was filed but was denied
• 2002 - Got separated from ex-husband and eventually divorced and 2 year old US citizen son lived with me outside US ever since (with his father's consent)
• 2013 - Got officially/legally re-married to non-US citizen

My overstay was 13 years ago so my 10 year ban is over. I work for a US based company and they have asked that I visit for 5 days to attend Business Reviews/Meetings. They have provided me with the invitation letter and other supporting documents. I am now scheduled for a B1 interview and was just thinking about what my chances are... I am pretty much settled and have moved on with my life just fine but it would help me career-wise if I would be able to visit again.

Even though your ban is over you have a black mark for prior bad behavior and that means they will be predisposed to deny you a second visitors visa. You will need to present a strong case why you will not repeat your prior behavior which is made harder by a US resident mother a USC child . The work and non US resident spouse are positive factors but I wouldn't buy tickets without a visa in hand.

This will not be over quickly. You will not enjoy this.

Pretty unlikely but no harm trying.

Presumably your Employer is paying for the application so no cost.

Very, very slim chance.

You really need to convince the CO to grant you a visa, then the POE is going to be another story entirely. Good luck, do let us VJ members know if you are granted a visa. The problem is not with your GC or immigrant intent in the past, it's that you have abused B visa before and have over stayed six years, not just couple of months, but six years!

Go for it and see what happens.

The negative is U overstayed B4, so

having strong proof of ties to your

country would definitely be needed, it

also depends on the CO & convincing

him or her that there is no immigrant intent

or planned overstay.

You are now married to a non-citizen (if not

traveling with U) along with strong ties may

give U a slim chance since your employer

is also involved if there is doc to prove it

no telling which way it could go.

Anyone can have a prob at POE on rare

occasions. don't even focus on poe at this

point

Just want to provide an update. I had my interview last Friday and my visa application got... APPROVED!

I believe being honest and forthright on my application and during the interview helped. Alot of questions and I had to go through my whole history as it was 13 years ago.

Thanks everyone for your replies and comments. Thought I'd share my story, i never thought i would get a chance of getting a visa again,but i did...Important thing is not to lose hope! :goofy:
