"We just had our 3rd interview this past friday, and a lawyer was present but didn't say a word during or after." If that is your lawyer, and he is not talking to you, you need a new lawyer. They think they walk on water, but they work for YOU.

Perhaps the Lawyer knows all the details so there was nothing the needed to be said?

okay let me clear the air. my husband has owned his company but not here in the US, he owned one in Israel and when he came here he was not working, he was training other people to do the job instead for when he could open his company. Why I omitted this info is because I do not see why his work status has anything to do with it, they have not brought that up once. During our 3 interviews, they barely asked any questions about us, just the usual when were you married and how, and that was it. The rest of the grilling interviews were about the guy who left the country and the girl who wrote the posion letter, thus the reason for my question as to are either of these basis for denial?

On their own, no.

Combined with your husband's activities in the US, yes. Absolutely.

Which is why everybody is asking questions.

So when he arrived on a tourist visa he knew he would be working in the future, so he trained people to do the job? Really sounds like an illegal work operation. H1B scam for his friends?

The things you are asking about are all connected to everything else. If the friend who was deported was involved in something bad, maybe they suspect your husband of being involved too.

Why would someone on a tourist visa know that he would be working soon and train people to work?

How did he know he was going to get work permission soon? Where were the people he was training from?

If your hsband followed every technicality and his AOS is not delayed because of that reason, then I think the person about which you have been grilled three times already has done something or is some kind of person of interest to the US or there is just something wrong there. What could it be is anyone's guess!

We don't know what your husband is mixed up with, you probably don't know either, but seems like USCIS knows and is thoroughly investigating before passing a verdict. AOS of US citizen spouses are not that quickly denied, particularly by USCIS which approves more than 90% pf petitions that lands on its door step.

I am amazed that there are people who write poison letters and they are taken seriously! Scary how easy it is to ruin people's lives!

Unless your husband came to the US with substantial capital, somewhere in the vicinity of million dollars, and had a business plan, proposal and everything, he could not start training people for a business he was about start. Did he come prepared like that? What was the role of this deported friend in that business proposal? Why was this person deported?

Sorry, if it sound like anther round of grilling, but we are trying to understand the situation so that we can try to answer your question.

Assuming there is nothing to it, the letter is irrelevant. You see such references mainly where ex spouses are involved complaining of all sorts of things.

So if the sole issue is the letter then the issue is its contents which are seen to be both relevant and have validity.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”
