Am i eligible to file a VAWA? when and How can i do that?

Hi everybody, my husband abused me few months ago, they arrested him , then he left , i have a police report, and restraining orders, i dismissed the permanent RO, and decided to stay with him, i wanted to give myself another chance staying with him before i may definitely leave him, now i decided after giving myself all this time to think and to works things out that i can't stay with him anymore, he is not willing to change or to grow his mind, he insult me , he talk on my back, i feel he can abuse me again and again, now i can leave him & file for divorve ,

i will need to file for ROC on my green card next year, i have some questions & really i appreciate your help;

1. DO i MUST file for VAWA if i want to file ROC because my husband abused me? + sure i need proofs for bonafide marriage

2.What VAWA do for my case?

3.Do you think the domestic violence documents i have are enough ?

If you have a green card then you CANNOT file Vawa( I-360).You can file I-751 waiver based in extreme cruelty or based in bonafide marriage or both, if you will file based in extreme cruelty you don't need a divorce decree,if in bonafide marriage you need a divorce decree.

Hi thanks for your answer , yes i have a temporary green card , and i meant when i file for my I-751 if i need to file for Vawa! i thought i must file for vawa if im abused woman , so thanks again for your answer, this mean i can file to remove the condition on my green card like i have read based in bonafide marriage and based in extreme cruelty ,

i have another question plz: do i must to have a counselor or medical certificate for domestic violence if i file based in extreme cruelty?

you can't file Vawa.In the form I751 waiver there is the option for extreme cruelty.If you fill out based in extreme cruelty then you need to have a psychological evaluation.Please DON'T go for a 2/3 hours psychological evaluation, because 90% of the evaluations I read were bad.Attend 4/5 sessions of therapy and then have a psychological evaluation done.A good evaluation should have 9/15 pages.Join the thread Vawa part 5 if you want to know more about extreme cruelty, we discuss in the thread about that as well,not just about Vawa.
