I actually don't know a lot of details about filing the AOS, we married before the 90 days period. It is financial issue,.. My husband doesn't have that much money like everybody else.. and it was more difficult because the fee was big and need in cash. :(

I did marry my fiancee within the 90 days period. thanks for the reply and info..

I always afraid if I am going outside without proper papers since not all people know about the process. One time I went to the military base to renewed my Pass ID and the lady at front desk did not know about visa expiration and kept asking me about that. I told her my expiration visa's date is not relevant since I my lawful present here started occurred from date on my I-94.

I didn't had the money to pay for my paperwork. My husband and i took a loan that we are repaying at the moment. I am not working and he is doing truck driving. He also had a previous credit card debt that we settled with the money from the loan. If we would have waited for his job to get us the money I probably wouldn't have file until now. At least now I know that in some months I will get my EAD approved and in production.

Im glad your husband thought of your papers first before anything else..We have few debt too, and he already got a loan from the bank for the renovation of our house, I wish I have foreseen this issues 3 years ago.. I was just so blind and don't know what to be done before, that I let him handle everything. Now I am the one who is suffering from it :( Im not so smart (sigh)

Problem is that if you don't get your papers right you could lose your family. Also if you file for your AOS and you will file for your Employment Authorization card and those get resolved within 90 days from filing normally. So you could start working and helping your family. I am sorry to hear that you had other financial reasons not to file but it is a priority now for you, and so it should be for your husband too. Honeykitten, we also had to get a loan but luckily my parents were able to loan us the money. It sucks borrowing money but you will be able to work and pay it back once your EAD is approved and will have peace of mind knowing they can't deport you once you file plus when approved you will get a 10yr GC and save money not having to file ROC on a 2yr. Lastly I don't know how much your hub earns but if your financial situation isn't too good then you may need to think about getting a co-sponsor. Good luck!

Anyone reading this should take note to set aside the AOS fee in advance. I hear people talk about as long as you get married within 90 days you are OK since their is no deadline to AOS, but being married to a US citizen does not give you any status. The scary thing for the K1 beneficiary is that should you end up divorcing, then you would have no basis to AOS. I personally (as the US citizen) would never put my spouse in this predicament, and would borrow the funds if necessary. This is not personally directed at you OP.

Honeykitten2008 as other posters have said you should apply for adjustment of status as soon as possible (and employment authorisation if you want to be able to work while waiting).

You married within 90 days and that helps your situation somewhat - but if you can somehow raise the I-485 application fee and biometrics then you should apply for AOS as soon as possible. As I understand it you have to be married *and* apply for AOS to safeguard your right to remain.

Yes the fee is high but if you can get the funds together it is well worth it.

My understanding is once you have an AOS application pending you should be fine to stay pending a decision being made. You may have to file additional forms as your situation is different from mine. Definitely look at the AOS guide and flowchart on this website.

I was able to apply for employment authorisation at the same time for no extra fee.

There are excellent guides on this website so be sure and check them out.
