Termination of K3 status occurs 30 days following: (1) the denial or revocation of I-130; (2) denial or revocation of Immigrant Visa or Adjustment of Status Application; (3) the K-3’s divorce from USC; (4) K-4 ‘s marriage. Denial of K3 also results in the denial of K4.

K3/K4 cannot change their status in the US nor nonimmigrant visa cannot be changed to K3/K4 status. K3 cannot adjust status to permanent residence except on the basis of the marriage to the same USC who petitioned for K3 status.

K3 visa maybe extended beyond 32 years but only if a USC spouse has filed and has not received yet an approval of I-130
