I have a quick question on question 13 on the I-864 affidavit of support.

The check box says "I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only the most recent tax year."

I have completed and attached my 2013 returns, but did not file taxes in 2012 as I was a full-time student and was below the required federal level to file. My 2013 income is sufficient for the poverty guidelines and I have included a letter explaining why I didn't file in 2013. I also wrote a brief note right on the form.

Should I check the box or leave it blank? It only says the 2013 returns are required, but I am worried they might just turn it away because that one box isn't checked.

Any advice would be appreciated!

I accidentally created 2 timelines and it looks like a need to contact the admin to have one deleted. Trying to sort that out. In the meantime, would appreciate any info on my question above.

What visa are you applying for? The I-134 is typically used for the K1 visa process, the I-864 is typically used later on in the post K-1 related AOS visa processes.

A&B was asking what immigration process you are in the middle of. You posted in the K-1 forum, but the I-864 is not typically used for the K-1. He was wanting to place your post in the correct forum for your question and the process you are going through currently. A couple of your other threads showed you had a K-1 visa interview in June, so this is perhaps for AOS?

As for your question, if you filed in 2013 and 2011, but not 2012, then yes, go ahead and check the box and include the statement explaining why you were not legally required to file in 2012.

You also stated your 2013 is sufficient to meet the requirement. Are you self-employed? What about your current annual income?
