Hi everyone,

I just got notified today that we got an RFE for AOS. Of course, I still have no idea what it's for till we get it in the mail. It seems, though, that the most popular ones are either for civil surgeons or for sponsor I864 papers. My question is, when we applied I ( the petitioner) was unemployed at the time so we used a co sponsor. Just in case the RFE is for the co-sponsor, can we just make a note to them that we don't need a co-sponsor anymore since we are both working now (my husband and I)? Can we just send pay stubs and a letter from the employer? Any input would be much appreciated. Thanks!

My advice is to wait what the RFE wants. Mine was as simple as another copy of my wife Expired and current EAD cards (which i sent with the papers but apparently they wanted the same ones mailed to them again.)

But if it is not about the co sponsor then you should bring your supporting evidence at your interview. It will help make your case stronger that you are above the specified poverty level.

They check the income based almost on most recent tax return. So basically, if your spouse most recent tax return (2013) doesn't reflect poverty guideline, you still need a joint sponsor. Good luck.

It is speculation what the RFE is for without the actual notice. Guessing and speculating at this time is of marginal utility. Wait until you get your actual RFE notice. Upon receipt of the RFE, respond accurately and promptly.

Thanks for the replies. I am just confused on what it could possibly be, since I see most of the RFE's get sent out early on. We already got AP and EAD and even the interview waiver letter back in April. So that's why I was confused as to why we would be getting an RFE now??
