1. Maybe. Depends on if you should have reason to suspect it's stolen, lot of different levels on that one

2. No-- You are guilty but depending on the amount, not in as much trouble as the guy who made it, if he is caught . distribution and manufacturing usually carries a much stiffer penalty.
