So if by Tuesday or Weds next week we have a marriage certificate - what should we immediately do following that? As far as what fees we will immediately have to cover next week, what will they be?

If you marry after the 90 days you can adjust by filing a concurrent I-130/I-485 application. You wasted $420 by doing this. Good luck.

You need $420 for the I 130 and $1070 for the I 485. Don't forget to file the I 765 for the EAD, even though it says there's a fee in the instructions, it's free if you submit it together with the I 485. You would also need to submit the other documentation the form requires like the affidavit of support and all that stuff. Unless you already have them, some of these docs may take you a while to get, like the tax transcripts and if you're using a joint sponsor their docs as well. I wonder if you could submit the application with the most important stuff and send anything else in when you get RFE'd?

Will the affidavit of support gonna be necessary again? We already filled this up on the first part of the process. Our financial situation changed once I got here though, and that's why my fiance and I didn't marry within the 90 days.

Because they didn't get married within the validity of the K1 visa and that clearly complicates their situation.

Why is it a tough predicament?


The affidavit of support you submitted with the K1 isn't the same as the one you're going to need for the AOS. The one you needed for the K1 process was the I 134, now you need the I 864 with the AOS. Also, if your financial situation changed meaning you're not making enough, 125% of the poverty level, then you would need a joint sponsor.

Also if you're financial situation is what affected your being able to get married within the 90 days, it can help you explain why failed to meet the 90 day marriage requirement should it come up during the AOS process.

Yes, you will need to file another affidavit of support since you can no longer adjust under K1.

If your fiance/husband cannot afford to support you, you'll need to find a co-sponsor.

We really don't need judgments, the reasons why my fiance and I couldn't get married is our business only. If you have helpful information, great; if not, save your comments to yourself.

The OP stated they ran into some financial trouble. It's a good enough excuse in my book, the important thing is that they actually plan on getting married. If you ask me the 90 day requirement is unfair to those that want to plan an actual wedding, which can take longer than 3 months. It's possible that the OP got laid off or something and couldn't afford a wedding, we don't know.

I understand that and genuinely mean it, hence why I cleared original post. BUT the whole process of the K1 is leading to getting married within 90 days. It takes very little money to go to a courthouse and legally marry. But, I hope they do soon and continue successfully with their journey. Just maybe better prepared for upcoming expenses.
