I-134 if income clearly exceeds 125% what supporting evidence?

As I am one of the many unfortunate ones stuck at the TSC, I thought I would start preparing some of the “next steps” documentation. However, I do not fully understand the instructions for the I-134 affidavit of support.

If your income level clearly exceeds the 125% requirement and has done so for many years, do you need to fill in any part of Question 7 other than "I derive an annual income of:”? In other words, must you list other assets such as deposits, investments, etc.?

Also, in the "Supporting Evidence" section of the instructions, it asks you to submit evidence "as appropriate" to demonstrate income and resources. If your income level clearly exceeds the 125% requirement and has done so for many years, do you need to submit both a "statement from an officer of the bank or other financial institutions with deposits" and the "statement from your employer" or is the statement from your employer by itself sufficient?

Do the answers to these questions depend on the country of the beneficiary? My beneficiary is from Ethiopia.

No, you do not need to list assets. You can leave that whole section blank. Unless your consulate's instructions specifically state you need bank statements, then no to those too. Just provide most recent tax transcript, letter from employer, and/or recent pay stubs to prove current income.

Can you please provide me a link saying military is only 100% poverty level? On the USCIS it talks about i 864. Nothing about i-134 on poverty level.

Also everytime we call Embassy, they are clueless about the 100% military guideline.. lol

The poverty guidelines are for the I-864. They do not have one for the I-134, other than the mention of the I-134 only needing 100% and not 125%. That is not the case for all consulates though. I am a sole sponsor, and well over 125% margin,

but I submitted many evidence to them

in hopes of making fiancee's interview approval more smooth.

Thank you KayDeeCee. I guess I will have to wait until I see the consulate's instructions. I submitted the K-129f in May but sadly with the 7 month backlog at TSC, I don't think I will see those instructions for at least another 5 months or so . . .

I guess I can order the tax transcript now but will also have to wait to compile the letter from my employer and tax stubs as I suspect those will need to be "current" not 5 months old . . .

Thank you DualityOneness for including the link to your checklist. It will be a very useful tool. I see that you did include a lot of supplementary information and that you had the help/advice of an immigration attorney. I certainly want things to go smoothly but would prefer to keep my package as "light" as possible (I saw the thread where people were weighing their packets . . .); there are so many requirements that I'd rather not add to the list if not absolutely necessary.

My current K1 visa Immigration Attorneys are wonderful VJ members and no one else.

And yes, keep you package as light as possible, but make sure its also sufficient.

Whenever I had any doubts, I just supplied more information...hoping to

over qualify (if there is such a thing...LOL). In all honesty, I'm just trying to

do things to help my fiancee have smooth interview and get her visa approved quickly.
