At what stage does a botched execution become a cruel and unusual punishment? Personally of course I think the execution is in itself cruel and unusual but being that it is legal and it is supposed to be carried out with the minimum of pain and discomfort (for all sorts of reasons not limited to causing unnecessary suffering to the person being executed) how many hours of still remaining alive and suffering does it take?

Just because he was breathing funny/snorting or whatever does NOT mean he was in pain or suffering or even aware of the situation. I would guess he was in deep sedation, and felt nothing during this period.

Not only that but it doesn't stop crime in Texas either. The death penalty as a deterrent if a huge failure. What the death penalty conveys is one basic message; that sometimes, it is okay to kill another person. Must be if the state does it. And so people take up that message and, well, kill.

Thinking the death penalty is going to be a deterrent for homicide is silly. It's just as silly to think passing gun control laws are going to do anything to prevent gun homicides. Not with 330+ million legal and illegal guns in circulation in this country.

People thinking it's ok to kill other people is the real issue. Just so happens that attitude seems to be more prevalent among young black men than any other demographic.
