I'm a naturalized US citizen. My mother lives in Romania. She has been denied her tourist visa to come visit me 3 times. She became a Hungarian citizen this year (Hunagarians don't require visas to visit the US, Romanians do)and will come as a tourist in August, however she is afraid she might be refused entry as she was denied her visa previously (she is heard of similar cases where people where denied entry and sent right back).Should we be worried? Does she have any rights as the mother of a US citizen? Should she mention that she is coming to see me when questioned by the immigration officer? She does not want to come here permanently. She just wants to visit for right now. If they don't let her in is there anything I can do? Will they send her straight back or can she fly somewhere else, like Cancun for example?

Being the mother of a US citizen offers her zero rights.

Coming to the US as a tourist is a privilege.

She should always tell the truth, if she is coming to visit you, she should say so.

If they do not let her in there is nothing you can do. They will send her back to Romania on the next available flight. Why would she go to Cancun?

She can carry strong ties to Hungary or Romania to show why she MUST return.

Also, when she applies for her ESTA clearance she will have to disclose that she has previously been denied a visa

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

When she applies for her ESTA and discloses she was previously denied a visa she may not be approved for VWP travel. To omit the refusal on the ESTA is a material misrepresentation and when she arrives they will turn her away and could ban her for life. Previous denials are about the traveler NOT the passport when answering immigration questions.

This will not be over quickly. You will not enjoy this.

She can't travel without an ESTA, even as a Hungarian citizen. With 3 denials that she'll have to mention on the ESTA application I doubt she'll get approved. My husband had only one denial and the ESTA was declined. He was lucky enough to have his B-2 visa approved on the second try, but that was with me living with him in his country. Without strong ties to Romania she'll have a hard time.

Her ESTA was approved a while back but she did not mention the denials when she applied for visas as a Romanian citizen because she thought the question was in reference to her as a Hungarian citizen. When they scan her Hungarian passport at the airport will they see the denials from Romania?

She should also arm herself with strong ties in Hungary

as that citizen now intending to return home...se must

disclose B4 coming & tell the truth, if she is refused entry,

she would only be able to go vacation in Cancun if holding

that ticket, but not allowed to purchase one then...She

would be repatriated to her birth country, where from there

she could fly to her adopted country (use to be that way yrs ago cant

say if its been changed or not)

She so she tries to enter using an esta where she lied to one of the very important questions you can expect her to be turned around and banned. Did she think her finger prints changed when she crossed the border ?

Th questions pertain to her, not her passport.

She needs to update ESTA, this is a big deal if she lied....which she did

Since she has prior visa denials, she lied by ticking the box that states she did not have any prior visa denials.

She fraudulently obtained ESTA.

No good can come of trying to used fraudulently obtained ESTA.

She needs to apply for a visitor visa and disclose her prior denials.
