HI, Im filling up the form i-130 for my mom, and I have a question regarding sons and daughters. i had a twin sister and die 5 days after she was born, do i still need to put her name in the field of sons and daughters?

I don't think so. I know you have to put it for naturalization application because it specifically says to put all children alive, missing, or deceased.

I just double checked the instructions say nothing about putting children that are missing or deceased. The form itself also doesn't provide a space to put if the child is alive or not, so I would just put yourself obviously, her spouse(if she's married) and any other kids she may have whether or not they will apply for a visa.

THANKS a lot, im worried because my birth certificate indicates that i have twins. im scared they will question my mom in the embassy about this. and ask why did e not put her name.

You're welcome. You don't have anything to worry about because you are the citizen and you are the one petitioning. Your twin has nothing to do with the petition. You can't really put someone on a petition that they're not asking for and if anything all she has to do is tell the truth. That you didn't put your twin because she died a few days after being born and wasn't relevant to the petition. Trust me the parent child cases are the easiest as long as you have enough income or have a good sponsor and otherwise meet all the other immigration requirements. The process is nowhere near as complicated as for a spouse when it comes to the interview. The paperwork is also relatively easy because it's a biological relationship so there is no "bona fides" to prove. Good luck!

Yes. There you would put her spouse (if she's married), yourself as her child, and any other siblings you may have whether or not they are immigrating with her. Your twin sister you don't have to put because she is deceased. However, if you would like to avoid any confusion for your mother's interview you can write down your twin sister and write deceased in parenthesis next to her name. You don't have to, but if it makes you more comfortable, then by all means do so.

i got a mail from uscis that they sent my approved papers in NVC.

do I need to wait for nvc mail to come stating that they receive my docs? or call them like everyone here is doing? when can I call them?

Congrats! NVC probably hasn't yet given it a new case number, but it doesn't hurt to call them once in a while. If you do get the new case number and invoice number from an operator, you still won't be able to pay the AOS fee until it's invoiced. You might be able to fill out the DS-261 (choice of agent form) a day or so before the AOS fee is invoiced though, which could slightly shorten the wait for the IV fee to be invoiced. Assuming you included the G-1145 with the petition, the first e-mail you'll receive from NVC will be the AOS invoice. If you didn't include it with the petition, you can have NVC add the e-mail addresses (yours and your mom's) to your case once it's been entered into their system.

It can take up to 30 days for the NVC to receive the petition and send you out the AOS invoice. You can call before to stay on top of it, I'm not sure if that helps though. I would take this time to start filling out the I-864 and gathering the docs and fees that you will need. Keep in mind the new fees for AOS and the IV. The things that you should leave for last are things that have to be more recent, like the employment letter/paystubs.

You can ask if they got your case. You give them your USCIS case number. If they start asking you info about petitioner/beneficiary name and DOB, then they have received the case. That's when you ask for the NVC case number(MNL...), invoice number and/or add your email address to the file. HTH
