filing AOS more than 2 years after marriage...need answer pls..

Hello everyone, if AOS will be filed more than 2 years after marriage, do we need to submit I-130? So confuse coz I thought I-130 will be submitted if the marriage took place after the 90days period. I will appreciate helpful answers. Thank you.

I-130 is for alien relatives outside of the U.S.

We are both living here in the US. I am just so confuse coz I have read in the forum that if the AOS is filed more than 2 yrs after the marriage took place, I-130 should also be submitted. I just really dont wanna waste money if we dont really have to submit the form I-130.

Hi, regardless of how long you have been married once you chose to get a green card through a family relationship - sibling, parents, spouse, kids, you must apply for the I130. The I130 proves your relationship which is the basis for the I485 being approved. So go ahead and file both forms together provided your spouse is a US Citizen.

No, this is not true.

OP; I answered your PM, but they changed the rule, so a K-1 who files after 2 years no longer needs to add in an I-130. Just the normal I-485 packet, based on an approved I-129F petition and subsequent marriage to the petitioner within 90 days or arriving, choice C.
