I am on the same boat with you. Our PD is 8/16/2002. One of the 2 children is now 21 years 7 months old, so his name is not listed on the IV application page (it shows up, but it says "not available"). I called the NVC (at 7am E.T. to get to a representative) and she said to file the AOS application without that child's name to not delay the process and we can petition for him to be included at time of interview.

Later on, in the letter received by NVC to pay IV fees, they recommend to write a detailed explanation of CSPA eligibility and it will be forwarded to the U.S. Embassy or Consulate for a decision.

I am in the process of submitting DS-260 and is now stuck on the question "is this child immigrating to the U.S. with you?" Not sure if I should answer yes or no since we are attaching the letter with our DS-260 documents (as well as sending it in an email). If anybody have went through this, please advise on how to answer this question. I will also call NVC tomorrow morning for advise.

I called NVC and they said CSPA for over 21 child will be determined at interview.

Here are what I did: 1st time I submitted the AOS with the over 21 child (his name was not listed on NVC website) in the application. NVC sent a letter said my household size was not correct. Then I resubmitted the AOS without his name. I also submitted visa applications for other household members.

I plan to submit his CSPA letter along with supporting documents and form DS-230 with supporting documents to NVC. Pease advice
