Hey guys,

I know when we all go for interviews they will ask for our I-134 forms, so I'm thinking if Sam's daddy is our co-spousor, does it still matter for me to give them my bank and salary statement to prove that I could support myself? I mean if we have a spousor, does it mean it's only important to bring proofs of his finanical status which shows he could support me?

2006-06-15: Engaged in Italy

2006-10-10: I-129F Sent to NSC

2006-10-23: I-129F NOA1 from CSC

2007-01-19: Touched finally!! Send us a NOA2 please!!

2007-01-19: WE GOT NOA2!!!! HOLY COW!!!!!!!!!!!!!

2007-01-20: Touched again

2007-01-25: Received NOA2 in mail

2007-02-01: File forwarded to Consulate from NVC

2007-02-08: Consulate received our file and right away mailed Packet 3!

2007-02-10: Packet 3 received!

2007-02-23: Gone for medical check and police report

2007-03-07: Mailed in all the forms needed to the consulate

2007-03-13: Consulate mailed out Packet 4!

2007-03-16: Packet 4 received!

2007-04-16: Interview Day!

2007-08-11: Us Wedding

Looking forward to the day two beans get together and live happily ever after!

The beneficiary's financial status is never taken into account. Only the sponsor and/or co-sponsor in the US. You must attach sufficient amounts of the evidence requested with the I-134 for each sponsor. (Bank letter, tax returns, paystubs, etc).

Also, most of this info can be found in the guides or by doing a quick search.

You'll want both Sam's and his dad's bank letters and tax transcripts and whatever other evidence you can come up with for the I-134, even if Sam's is insufficient on its own. It's better to have lots of information, imho.

You are the visa applicant or the petioner?

If the visa applicant's salary is going to continue when they move to the USA then they may not need a sponsor for their K visa. But most people have to quit their jobs when they leave their country and move to the USA, so their present salary is meaningless. (An exception would be someone working for an international company and the company will transfer them to a facility in the USA.)

Or if they've got savings or investments that they could live off for a while, but it seems that few K-visa applicants have large savings.

Some visa applicants from the UK have met the public charge requirements with their own financial resources, thus not requiring a sponsor for their K visa.

Not true. If a K-visa applicant has sufficient financial resources of their own to meet the public charge requirements then a sponsor is not needed. It doesn't happen often, but a number of K-visa applicants from the UK have done it.

Possibly more people could do it if they realized it was a possiblity and tried, but the lemming instinct is hard to overcome.

I didn't really think about the possibility of working for an international company. Good catch.

However, of all the things I've read, it's always said that the US Citizen has to prove they can support the fiance(e) and they never ask for the others income.

I thought it was a little strange. What if the non-US part is loaded (:)), then why would the US citizen still have to prove they could support them!?

And some occupations make a person excludable (although a waiver can be applied for in marriage-based cases).

You have a lot of company. And you need to read more. On this issue, try reading 9 FAM 40.41 (Public Charge) Notes, being careful to distinguish between the sections that deal with immigrant visas, where I-864 applies, and the sections that deal with non-immigrant visas, including the K visas, where I-864 does not apply.

What a non-immigrant visa applicant has to demonstrate is that they will not become a public charge after entering the USA. If they cannot do this using their own resources then they can do it by obtaining a sponsor. The sponsor does not have to be the petitioner, although that's reasonably the first person to look to for sponsorship for a K visa.

If your job is a dancer in a Bangkok go-go bar they will most definitely see you differently, and it will make a difference.
