No, they approved the visa based on your husband supporting you, not because he was paying for the trip-- you DO have an income...it's supplied by your husband. Obviously, when a spouse does not have paid employment outside the home or for minor children, they look at the income stream for the family. That does not mean the visa is approved based on who is paying for the trip. It means that based on your marriage, your ties to another country, and your husband's financial support, they believed you would not stay in the US.

wait...

but according to visa journey members, you cant get the tourist visa based on somebody else, no matter who he is and how close you are related to him!

i got a via based on my husband when people here say you are alone in this! like my husband had no affect on it.

i have no ties to my country either, i have zero money. they didn't care about all this, seemed to care only about who is sponsoring me.

and i have many reasons to NOT leave the US..i come from a high fraud country where my homegirls really put a red mark on us all good girls who truly care for our USC hubby..

You don't indicate what country you are from which certainly affects the outcome. In fact many embassies will not grant a B 2 if the applicant is married to a USC. If that is the case the immigrants ties are stronger to the husband therefore if the USC husband is in the USA there may be little reason to return.

You weren't granted a tourist visa because your husband paid for the trip. You simply got lucky

I COME FROM A HIGH FRAUD COUNTRY.

i didn't get lucky.. its just my husband makes decent money..

please people stop complicating everything..this is ridiculous

I think the issue here is one of communication, English not being a first language, you can not sponsor a tourist visa to the US.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

The V J members are correct.

I don't know how or why you were granted a tourist visa because you are the poster child for why people are denied every day. Of course your country remains a mystery but as we see in your comments it doesn't sound like you are going to honor the tourist visa anyway.

I think Boiler is partly right but it isn't simply language.

People that apply for tourist visas do so on their own merits not on some possible relationship with another person.

People commit fraud all the time.

Coming on here to brag about strikes me as odd.

it isn't the facts that determine your character; rather your actions. That may cause those pathetic tears but with you I doubt those will wash away your problems.

Don't worry about honor. Get plenty of sleep and call someone that cares in the morning. Better put that passport in a plastic bag because its getting a little slimy and smelly from the B S you refer to.

Applicants must demonstrate that they are properly classifiable as visitors under U.S. law by:

  • ball.gif Evidence which shows the purpose of the trip, intent to depart the United States, and arrangements made to cover the costs of the trip may be provided. It is impossible to specify the exact form the documentation should take since applicants' circumstances vary greatly.
  • ball.gif Those applicants who do not have sufficient funds to support themselves while in the U.S. must present convincing evidence that an interested person will provide support.
  • ball.gif Depending on individual circumstances, applicants may provide other documentation substantiating the trip's purpose and specifying the nature of binding obligations, such as family ties or employment, which would compel their return abroad.

It might be a language difference thing but the point being made is that in visa terms sponsoring someone and financially supporting someone are two different things.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Ha thanks. I came back to follow up and thought I was in the wrong thread.

Anyway, I see there is some discussion about the "financial support" section. I can see both sides of the argument. Before ever posting this thread my wife and I got on the US Embassy page in Bogota Colombia and it says the only things you "have to" have to apply are the passport, barcode from the online ds-160 and passport photos.

Obviously we are going to try to gather "evidence" for her mother to take to the interview (and I will ask more about that later), but I still can't decide whether or not showing an ability to provide support while her mother is here visiting. I mean, wouldn't they want to know that if something bad happened and she had to go to the hospital or something we have the money to pay for it and she wouldn't become a burden to the system? In all honesty her mom doesn't have much money. We will probably pay for half her plane ticket and all that she needs while she is here.

Something else we've been wondering is if it might be better for her to see a lawyer or someone in Colombia that has experience doing tourist visas. If we just have to pay like $75 or something and we know that she's getting the forms all filled out properly I think it would be worth it.

The forms for a tourist visa are easy to do on your own.

There's nothing a lawyer could put on there that you can't do yourself so you'd be likely wasting your money. Lawyers don't have any special ways to give an applicant more chance of approval.
