Hi,

We're new to this forum and are starting the process (currently preparing our I-129F) that will, hopefully, lead to me relocating to be with my fiancee in Arizona. I've done some research and found that I will need to take a Police disclosure with me to interview if/when we get that far.

I will be 31 years old in February and was caught in possession of cannabis at the age of 17. I pleaded guilty by letter and was sentenced to £125 fine when I was 18. Then, just a few days later, was caught again, prosecuted and fined another £150. Stupid, I know. Such is the folly of youth!

These convictions, whilst spent under the Rehabilitiation of Offenders Act, will be present on my disclosure and I fear the worst for our K1 application.

Can anyone offer insight, advice, words of experience please? We are totally new at this and it's quite a steep learning curve!

03/12/07: NOA1 received!

05/23/07: Touched!!!

06/01/07: RFE for divorce/death certificates. We've never been married!

06/05/07: RFE response delivered by Fedex to CSC - notarized statement affirming no marriages

06/15/07: No confirmation of receipt of RFE response yet. Assumed lost, resent by regular mail

06/19/07: RFE response received

06/20/07: 2nd RFE - Write "none" under Names of Former Spouse on I129f and return :(

06/26/07: Response to second RFE received

06/29/07: Touched

07/07/07: Touched

07/11/07: Approved NOA2!!!! Finally!

Yep, I think you do. All drugs convictions are frowned upon by the USA, normally resulting in a denial...hence your need for a waiver. I'm sure others here are much more knowledgeable on this though!

Feb 2005 - both return to Germany

Aug 2006 - getting married

10/05/2006 - received interview invite

11/01/2006 - INTERVIEW in Frankfurt - approved!

11/04/2006 - VISA IN HAND!!

12/21/2006 - POE San Francisco and ON TO SEA!

You may very well need a waiver a part of the I-129F process - you may want to check the IMBRA forum for more information regarding this.

You will definintely need a waiver at the consulate level, which will include the 601 waiver and hardship letter from the USC proving extreme hardship if your waiver is not approved and she is required to relocate permanently to your country. Check immigrate2us.net for more information on this part of the waiver process and hardship letter.

So, like, they seriously care if you smoked pot???? Isn't it legal in Canada? I don't get why this is such a big deal, really. I mean I have glaucoma so technically I can legally smoke it here. It's not like it's smoking crack or something.

So, like, they seriously care if you smoked pot???? Isn't it legal in Canada? I don't get why this is such a big deal, really. I mean I have glaucoma so technically I can legally smoke it here. It's not like it's smoking crack or something.

But he's not emigrating to Canada & it was illegal when he broke the law so yeah, they kinda care bout stuff like that
