4 month returned CR1 visa, help!

Hi folks
I and my husband are new members in this group. We are glad to find you all here. Nice to meet you all.

This is our story:

I met my husband while i was a student in Korea and he had his tour there. We known each other for more than a year before we got married in my home country, Indonesia. We had church wedding also cultural wedding, where an officer from civil registrate office attended our wedding and then she furthermore took care our legalization of marriage under Indonesia Law. We got married on Oct 12th, 2013 and we started our visa CR1 petition on December 2nd, 2013. Myhusband filed it in Korea for expedite Visa since he had his PCS Order at that time to went to US. On March 12th, i had my interview but cos my husband missed his divorce decree 2010 then the CO gave me a slip of paper that i could come anytime in a year to embassy and hand him the divorce decree, and after that he would give me the visa. The next day my husband faxed his divorce decree 2014 (He said it is a revised edition of divorcee decree cos he has kids from his ex and there are some changing agreement).

Next is the CO think his divorce was finalized on 2014 instead of 2010. And CO think that i cant get CR1 visa, suggest my husband to file K-1 since CO think our marriage is VOID cos it was happened before my husband got divorce. But we are insisting that we want CR1 Visa. Finally he returned our CR1 visa petition to USCIS for reaffirmation or revocation, when we tracked it online we knew that it was accepted by NVC on March 25th. Since then, my husband been pro-active to call NVC and the answer always same "It is under review". Its been 4 months and still there is no news and our case just sit on NVC.

We contacted congressman (Texas, 16th District) like 2 and half week ago. After a week he responded us that he forwarded us to the congresswoman who knows the immigration better. My husband talked to the congresswoman and she asked him questions regarding our Visa and stuff. Then like a week after that my husband called her but she told him that she was so busy at that time and asked myhusband to call her later. Myhusband doesnt contact her yet. We paln to contact her in 3 days later. My questions here are :

1. How much any longer we have to wait till they review our case? Is there any timeline for the returned petition?

2. Does my husband need to send Privacy Consent Form to congresswoman before she can act on our behalf eventough she told us she take care this?

3. Do you have any suggestion about the congressman/woman who can help us and really care about this immigration issues?

4. He is in the military and active duty right now in Ft. Bliss, El paso Texas, is there anything about being in military can help us through our situation now?

5. My husband starting to think that he want to refile, is that ok? Dont it gonna make it more difficult for us to get the visa done?

6. Another suggestion and input are welcomed.

When was your husband actually divorced? If 2010, why does the IO think it's 2014?

Based on myhusband, it is 2010. But i am wondering too, if that so, why the CO returned the petition. This is the one i want to prove. In addition, when we were dating he showed me his divorce decree 2010, copied one. And by the end of April 2014, he sent it via email, those original 2010 that he got from the court house to me (Cos i was about to annul our marriage). He said that its so difficult to get the original one when he was in Korea. So after he returned to US, he obtained that from the court house. He sent those 2010 divorce decree to CO but failed cos his email is blocked permanently by CO. Since then, he sent it to NVC as an additional documents and in the email, he explained abt it, that those 2014 is the revised edition of his divorce decree certificate.

From myside, since i keep contact with CO, i also attached those 2010 divorce decree when i emailed the CO. Co's resonses was to talk to NVC and USCIS about mycase. I am really confuse now. Plese any advice

This makes no sense you say he had the 2010 decree but his email is blocked (why don;t you then take in person) but instead he goes gets an updated decree that's dated 2014. If I was CO I would be confused also. Why haven;t you taken the 2010 you say you have to the embassy yourself?

My interviewe was done by 12th March, 2014 -- Missed divorce decree.

Next day, 13rd March, 2014, my husband faxed 2014 (he told it is revised edition) divorce decree, since thats the only divorcee decree he had at that time (maybe he thought it was fine to showed it to CO) -- Problem was started to come, and CO started to think that his divorce done by 2014. He suggested my husband to file K-1. And told us that that he couldnt decide anything, but USCIS is, Returned it to USICS via NVC. Visa petition was accepted by NVC by March 25th, 2014.

Those 2010 was gotten by my husband by last April 2010 --

He sent email to CO but this time he couldnt anymore since CO blocked his email permanently (there were some arguemnets via phone between CO and myhusband, My husband was in US, and that CO is in Indonesia). That arguement so tight that made CO upset (i guess this is the reason for CO to blocked him). Since myhusband coulndt sent via email then he sent it to NVC and explained it in his email via NVCinquire. Also at the same day, myhusband sent me those 2010 divorce decree. Then i emailed the CO with attachment of 2010 divorce decree. CO's responses was to contact NVC and USCIS.

I really hope that i can bring it myself to embassy but since the CO unpatiently returned that petition then i cant go to embassy and ask 2nd interview no more. That is why CO asked me to contact NVC and USCIS.

Now -- We keep contacting NVC, been 4 months and the result always same "Under review" ... then congressman/woman. In addition, we have that 2010 divorce decree now ...

Timeline

NVC will return your petition to USCIS where they will review the case and send him a Notice of Intent to Revoke. That will explain all the reasons the visa was denied. You both will have 30 days only to respond and send proof of why the embassy was wrong to deny your visa. If he has the 2010 divorce decree is it in English? If not he needs to get it translated now so he can send that also to USCIS when the time comes.

It can take months to get the Notice of Intent to Revoke but he can start preparing for it now. I hope I understood what is going on with your case and given you the correct answer.

And now cos of this long process, i start to think maybe true those 2014 was the finalized of husband's divorce. If not, why should the CO returned it back to USCIS? But my husband been saying that 2010 was the right year of final divorce. Also i've been researching alot regarding mycase .... till now what i think is, there is no guarantee till USCIS make decision which one is right, CO or myhusband. But the process killing me. Its like i want to know ASAP who is right here so i can move on my life and decide the next step for me. Anyway, thx in advance

It can take months to get Notice of Intent to Revoke. Do you know average time for that lengthy waiting period? Its been 4 months for us. Is there any efforts we can do to make it faster? I readed that we can call congressman/woman, but yeah till nw we dont get any news eventough we talked to congressman/woman. Another is, by chance, do you know congressman/woman who can help us? The one we contected still no news from them. In addition, myhusband is station in Ft. Bliss, TX now (16th District of TX)

Okay I am sorry I thought your petition was still at embassy. I see now its been returned. Well usually getting back to USCIS its about 6 to 8 months before they will get to you. You could get an automatic reaffirm and sent right back to USCIS. Or do what Carolynhotstuff mentioned. All you can do is wait.

You could involve your congressman/senator nothing wrong with that to be on top of it. But it is truly a waiting game of patience on your part.

To clear thinks up yes I was divorced in 2010, and the decree was updated cause of the fact that my second kid was not in it and my ex wife wanted me to add him in to it so she could get more money for the surport of the kids. When I sent the updated on to the CO at the embassy I guess since the date it was updated for 2014 he thinks I was final in 2014 but my date of divorce was 2010. I have sent the 2010 decree to NVC and USCIS and to the embassy. I just have one question sould I wait for the visa to finish or just start a new one with the 2010 decree with it. Me and my wife are fight over what to do and with us being apart its making our marriage hard and to the point of breaking. So know I ask what is the best thing to do?

Well starting all over again buys you nothing but more time. You still have to wait and at the rate they are approving you are looking at a year. So don't see how that would help.

You need to wait it out and hopefully you will get o show the original document and get it all cleared up.

What myhusband want to say is, he would like to refile again cos he is an active duty military and usually if all things goes well., he can put in on military imiigartaion and get it on in 3-4 months. He already ask my permission since last April to refile. But me, i afraid that if he refile, then its goin to be mes up. Also, i cant get the truth (I do really want to know abt whther Myhusband is right, or CO is right, since im nt an USC so its like a blue for me). Any suggestion?

For this case that they sent the files back to USCIS it could take over 8-12 months for another interview, I don't think you should refile because when you apply again the system will show your previous petition because the case hasnt been closed. I think you and your husband have to be really patient and wait for a notice from USCIS because it look like they have your case and it under review before they sent out the notice of intent to rovoke. LIke someone mention above you have 30 days to submitt to prove why CO deny your visa application. SInce you have the divorce decree you shouldn't have problem to proof it. Good LUck

Even updated there should be final date of divorce on updated

I would say go back to court let them sort it out, sorting new date

as amendment or so , and your wife want answers she says to know

what to do, don't let this matter come between you both...if all fails

True, that is also mybig intention, that why there isno written on those 2014 divorce paper that those paper is a revised edition in order to add a new settlement and child custody, furthermore why the 2014 divorce paper does not mention that the final divorce was done back in 2010? Its like there are 2 divorce paper now, 2010 and 1014. And idk whom should i believe here. I keep thinking that i should believe the CO since he is from immigration, he should know better, But again before i really step to the next big decision, i have to make sure that i dont make mistake since its really complcated to get marry legally in my home country.

How if we cancel the previous petition and make a new one? Does nt it mean that they are also gonna erase all info abt our previous petition?
