Possible Ways to Overcome the Delay at TSC

Not sure how that's relevant, I have however heard of US History. Discrimination just has no argument here. You took a simple interpretation of workload imbalance and...I don't even know what you did with it, but you sure made it out to be something ridiculous. Just know that I have no ill will toward you, I'm just trying to figure out your logic.

Involving an immigration lawyer doesn't always mean there's a discrimination. I don't think someone was discriminating against my family for 10 yrs but i do believe that if an immigration lawyer was involved, the process would have gone faster whether visa approved or denied.

If an immigration lawyer has no baring on a case, there wouldn't be that specialty.

With that been said, I hope someone (higher at USCIS) would pick a phone or send an email to get some lazy folks at the TSC to get to work cause they are getting paid for doing nothing.

As someone who has endured both processes for K1 and CR-1, I'll add my two cents.

5 months (if you've been waiting longer, this does not apply to you) is a reasonable amount of time to wait for your petition to be approved. Anything beyond that is too long, I agree since we were approved at 5 months for the I-129F and over 6 months for the I-130. The reason there is media and news coverage for the I-130s is because of the efforts of people on this forum coordinating together and sending faxes, emails, and calling politicians all at ONCE. They contacted newspapers, news stations, and anyone that would listen. If this is your goal to achieve equality for your cases to not exceed 5 months, then by all means go for it!

But let me explain the difference between the K1 and CR-1/IR-1. Since our backlog was cleared at USCIS, this created a huge backlog at NVC. Your cases are only in NVC for a short amount of time to receive a case number and ship it off to the embassy for the applicant to take their documents and schedule the interview themselves, correct? (It's been a while since we did this, so forgive me if I'm hazy on the process now). The CR-1/IR-1s, however, have our documentation reviewed at the NVC (after we send it to them) for processing and they assign the interviews for us before shipping them off. This used to take about a month or two, so let's say 5 months at the USCIS and 2 months at NVC, plus maybe 2 more months til the interview = 8-9 months total. Right? That's if everything goes smoothly. There have been a massive amount of "checklists" for the silliest reasons and also a delay of being able to pay fees at the NVC level (y'all do this later once in the country for AOS). This delays the case by another month or two. So now those people are looking at 10-11 months at best.

Our case was filed Sept 13th and my husband won't be flying back til August 30th. That's almost a year of waiting, and we had it good since we didn't have any checklists and it only took us 6 months to get our I-130 approved, compared to others waiting 8-11 months!

I had no idea about the CR-1 process until I had to go through it. So just letting you guys know, it's not as if we go through the same process. We'll always have much more to wait than K1s. If you want equality, then I-130s should be approved in 2-3 months in order to accommodate an equal petition to interview timeline.

Yes, once it is finalized, we will all be sending the same letter to a director. We can email/mail it.

Additionally, we are also trying to get media attention for this delay. The more people who are aware of this issue, the more something can be done for it. So, more we have on board and the more that come together, the better chance we have of fixing the sloth in the system.

You're mistaken if you believe an immigration attorney is going to be able to speed up the process. They're in business to make money by helping people file that do not have the time or inclination to complete the process themselves. They make the filing process easier but they really can't speed it up. A good attorney will also make sure that your filing is 100% correct before it is submitted to minimize or eliminate RFEs. Ultimately your petition ends up in the same pile with all the rest.

As someone wrote in the TSC January thread.. my heart is breaking at the thought that me and my fiancee might not get our NOA2 this ever, even if we are May fillers.

You can go to this page, http://www.house.gov...entatives/find/, and type in zip code and it will tell you who your congressman is . It will also give a link to his web page and you can contact him from there.
