I don't think anyone is trying to say that I-129F petitioners are better or more important than any others. We are all starting to fight amongst ourselves and that's just making this more stressful for everyone.

What I think is being asked is that everyone is treated fairly, as a U.S. citizen, regardless of the petition you file for immigrant of a relative/spouse.

I understand that perhaps they receive more I-130's, and the higher completion rate helps as the petitioners may have been waiting longer. This is fine - we are just asking to be treated equally.

No one is asking TSC to ignore I-485 or I-130 petitioners - if they are so far behind, have CSC handle MORE I-129F petitions. Clearly they do not have enough work if they are processing within almost 80% of the national average of 5 months.

Let's not fight :(

(fixed petition number I-485)

This. The point wasn't that I-129Fs are more important or any other petition is more important (where did this even come from??), the point is that we're not the only ones out there getting the short end of the stick from TSC. If this argument is going to happen, the fact that it's taking slightly longer than 5 months to get an NOA2 for I-129Fs should NOT be the main focus. It should be mentioned of course, but the real argument here is about the imbalance of petitions between TSC and CSC and the way things are prioritized.

Immigration is NOT a right. It's not. It's a privilege. She didn't say anything about political laws. And that bold text you have at the end there also assumes that I-129Fs are no more important than any other petition, so you just invalidated your whole argument there.

jfgk1987,

I did not say that immigration is a right.

Immigration is a privilege that is why after all the processes, one is NOT GUARANTEED a visa! (sorry, if it comes off as screaming but i don't want you to miss that point.

However, the treatment that we get through this process is 'protected by law' under the 14th amendment. Likewise education is also a privilege but you can sue a school for denying you admission is you have everything right by the books.

Don't twist my statement around. i get offended when you fail to put my whole argument together to draw conclusions but rather, take a small phrase from a whole paragraph.

I am not saying that 129f is more important.

If you read from the whole argument i presented, the overall gist i want you to take from it is that I believe that all processes (I-130, I-129f, etc) are equally important.

sweetswinks' statement upheld the importance of I-130 over I-129f

"no more important " here means is not more important or the statement before and after that phrase are both important.

I am done!

I would pay to see someone bring this issue up in a court of law under the Equal Protection Clause, because it would be entertainment at its finest. That is most certainly not how the 14th amendment works.

I am done!

For the record I did not say I-130's held importance over I-129f's, I said this;

Considering I-130's are for alien relatives and they're having to wait 18 months to be with their husbands or wives, I would like to disagree with your statement that they are no more important that I-129f's. I believe a husband and wife say their vows with the right to not be separated. For those who choose either path, they are aware of what is best for them and their situation, but a marriage should not be separated for 2-3 times as long as an engaged couple.

My point was that I believe that I-130's should not take 2 - 3 times as long as I-129f's because they should be equal in processing times.

Furthermore I would like to point out that the focus should be on the hard numbers of CSC vs TSC to get them to distribute petitions evenly through both service centers to get an equal time of adjudication.

I guess you've never heard of an immigration lawyer.

Not sure how that's relevant, I have however heard of US History. Discrimination just has no argument here. You took a simple interpretation of workload imbalance and...I don't even know what you did with it, but you sure made it out to be something ridiculous. Just know that I have no ill will toward you, I'm just trying to figure out your logic.

We know that Service Centers have had different processing times from time to time. Texas was actually the fastest one less than a year ago... I expect people had tried to fix this before, too, and tried sending letters etc. to equalize the difference. Have any one of them succeeded? What ways did they try? Maybe we should look into that and try to find a way that would actually work..
