married to LPR, i-130 approved. when is PD current? coz i want to file i-486 package, also EAD

PD for F2A is May 01, 2012, which you are supposed to wait 2 years and 3 months at least.

Are you currently in the States with a valid status? or Are you out of status?

1. If you are currently here legally and you will maintain your status until PD, yes you can file AOS with approval receipt when your PD comes.

2. If you are out of status for a while and you are in the States, you can't adjust status here. You can leave but barred time might already be applied for you already, depending on how long you have been out of status. You can wait to AOS until your spouse becomes US citizen.

I-130 approval is only first phase, and it doesn't mean you are able to file AOS. Second phase is at NVC. You will need for a visa number available for you to file AOS because you are spouse of LPR, which visa is not available immediately. You will wait at least a year and a half to be able to file AOS. F2A Priority Date has retrogressed backward recently.

You MUST maintain your status while waiting for your visa number, IMHO, your spouse will become USC by then.

No, you will call them and they will upgrade your case to Immediate Relative of USC then you can file I-485 with your spouse I-130 approval letter. You will receive 10yrs GC by then.

No, you will call them and they will upgrade your case to Immediate Relative of USC then you can file I-485 with your spouse I-130 approval letter. You will receive 10yrs GC by then.

I got a letter from NVC( national visa center ) start with " your immigration visa petition is now eligible for a further processing at the national visa center you will need the following identification number to carry out the nest step in the immigration process"

Your NVC case number YYE3434323

Your Invoice ID number : 4234324

Your Beneficiary ID number : 8232321

Dose that mean my PD is current ?
