Hey Everyone, I have a few questions regarding which name to use on my AOS forms and some advice would be great.

I'm married to a USC and I want to use my new name (last name) on my AOS forms, however I have not been able to change my name on my document because I don't have a valid EAD. My husband file taxes using my maiden name and my I-693 is also filled out using my maiden name, but I want to use my new last name on my AOS forms, will this be a problem?

Do all the forms and supporting documents need to have the same last name?

Thank you

If you will be using your new married name legally, then you will fill out your AOS form with your new married name. Your marriage certificate will show why your name changed, and that's all the proof you need for the AOS application.

Use your married name from now on for any applications, etc.

You don't even have to change your passport until it expires, as long as you carry a certified copy of your marriage certificate in your purse at all times when you travel, and your airline tickets should be in your maiden name to match your passport.

For your taxes, not a problem that your husband submitted taxes with your maiden name. Go to social security and change your name there. When social security makes the change, it automatically filters through to the IRS computers.

Triniqueen,

Changing one's name is not a one-step process - it involves individually notifying each person or entity that you want to know you by the new name that you have made the change.

You've got to start somewhere, the I-485 is as good as any place to start.
