I am going to be visiting my wife in one week and I thought it would be a good time to start putting together our I-130 package. I have a couple questions I am not sure about at this point...

1. About 10 months ago, I filed for a K1 VISA. The last notice I got was that it was received by the NVC. That was on December 13th. Nothing has been acted on or I have not received any other notice. Would that have expired or should I send a letter to cancel?

2. We were married on June 19th in Denmark (the certificate is in English). She has not changed her name yet. Should we wait till the name change before we send the package?

3. She is a Romanian citizen living and going to school in Germany. She has been living there for about 8 years. She is thinking about applying for German citizenship in December (she would apply for dual citizenship). Would there be benefits to this? Would it make the VISA process more difficult in the long run? We are planning for her to move and work here in the long run.

4. For proof of bonifide marriage, I have a few documents. I have our marriage certificate, boarding passes from when I traveled there, pictures of our wedding, pictures of us, and well over 500 emails. We talk a lot on the phone too, but there is no specific record since we call using a skype plan. Since we live in different countries, we don't have so much in co-mingling of finances though I have sent money to her account in the past. Would that be enough? Should we get an affidavit? Anything else?

5. If I am not mistaken, if we sent the package in now, it would be roughly November of 2016 for the process (if all goes well of course)? Would there be any way she could come sooner? Like around August or September of 2016? I know she would have to return for her interview, right? I know it sounds weird, but she is currently going to school and there is no way for her to come before August of 2016 anyway.

1. You should have canceled it when you got married. But yes you should withdraw it if it's not expired.

2. Nope not needed.

3. Doesn't matter.

4. Should be good. I wouldn't send 500 emails just send a sample of your relationship. You can send screen shots of Skype logs as well. Co-mingling isn't always plausible, the USCIS understands this. There are some easy things though like adding a spouse to car insurance (or other insurance), beneficiary of life insurance etc...

5. Petition takes 4-8 months normally and NVC takes 3-6. So Aug is the earliest for moving. If she has VWP or a tourist visa she can visit of course.
